A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES GRANTING A
NEGATIVE DECLARATION, APPROVING THE REMODEL
AND EXPANSION OF A CHURCH FACILITY FOR
CONDITIONAL USE PERMIT NO. 1 REVISION AND
APPROVING THE USE OF TANDEM PARKING SPACES
IN THE EXISTING PARKING AREA FOR VARIANCE
NO. 153 AT 26231 SILVER SPUR ROAD.
WHEREAS, Ascension Lutheran Church has requested a
Conditional Use Permit Revision to expand and remodel an existing
church facility and a Variance for the use of tandem parking
spaces in an existing parking area; and
WHEREAS, after notice issued pursuant to the provision of the
Rancho Palos Verdes Development Code, a public hearing was held on
April 14, July 14, July 28 and October 13, 1987 at which time all
interested parties were given an opportunity to be heard and
present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That the proposal will have no significant
impacts on the environment, due to the implementation of the
mitigation measures contained in the Final Negative Declaration
for Environmental Assessment No. 508, which have been incorporated
into the design of the project.
Section 2: That the proposed project is not contrary with
the intent of the General Plan.
Section 3: That, given the project's location, design and
the uses adjacent to the subject property, which include single
family residential, granting the Conditional Use Permit will not
adversely affect the peace, health, safety or general welfare of
the area, nor will it be materially detrimental to property
values, jeopardize, endanger or otherwise constitute a menace to
the public health, safety or general welfare of persons or
properties in the surrounding area in that the new building will
not encroach into an area of extreme slope and the building height
will not significantly impair the primary views of surrounding
single family homes.
Section 4: That the subject property being approximately
3.63 acres, is adequate in size and shape to accommodate the
proposed uses and other development features which might be
prescribed in this Resolution.

Spur Road, a fully developed street with curbs and gutters and is
adequately served by public and private facilities and by a
highway of sufficient width and improvements to carry the kinds
and quantity of traffic the proposed project might generate.
Section 6: The findings to approve the use of tandem parking
spaces in the existing parking area are as follows:
a. That there are special circumstances related to the size,
shape and topography of the property which are not generally
found on other lots in the same zoning district, in that the
church is situated on a graded pad with an irregular and
limited amount of level area.
b. That there are special circumstances which unreasonably
restrict the applicant's ability to develop the property in
conformance with City development regulations, in that the
Development Code does not permit construction over slopes
greater than 35%.
C. That approval of the Variance will not confer a special
privilege on the applicant in relation to similarly situated
property owners in the same zoning district, in that other
religious institutional facilities use tandem parking
arrangements.
d. That approval of the Variance will not cause materially
detrimental effects on surrounding properties in that the
increase in parking will not significantly increase traffic
and congestion on the site.
e. That approval of the Variance would not be contrary to
the General Plan.
Section 7: For the foregoing reasons, the Planning
Commission of the City of Rancho Palos Verdes hereby; 1) approves
the Negative Declaration, 2) approves the expansion and remodel of
the existing church facility for Conditional Use Permit No. 1
Revision, and 3) approves the use of tandem parking spaces in the
existing parking area for Variance No. 153, subject to the
conditions of approval in Exhibit "A" of this Resolution.
PASSED, APPROVED and ADOPTED this 13th day of October, 1987.

EXHIBIT "A"
CONDITIONS OF APPROVAL
CONDITIONAL USE PERMIT NO. 1 REVISION
AND VARIANCE NO. 153
1. Detailed landscape and irrigation plans shall be submitted
for review and approval by the Director of Environmental
Services prior to issuance of any permits (except
demolition). Said plans shall incorporate drought tolerant
plant materials. Irrigation systems shall be on automatic
timers and shall be adjusted for seasonal water needs.
2. Any exterior lighting program for the parking lot and
building shall be submitted as a major amendment to the
Conditional Use Permit.
3. The trash enclosure shall be enclosed on four (4) sides of a
solid structure or wall, six (6) feet in height, constructed
of material compatible with the main structure and screened
from view from any public street. One side of the structure
shall be a solid, self -latching gate adjacent to adequately
paved concrete access for collection. The trash enclosure
shall be located in an accessible area subject to the
Director of Environmental Services.
4. Any roof -mounted equipment not included in this application
shall be subject to review and approval of the Director of
Environmental Services.
5. Final construction plans for the proposed building shall be
in substantial conformance with the plan approved by the
Planning Commission.
6. A minimum of 82 parking spaces shall be provided with a
maximum of 32 tandem spaces and 16 compact spaces.
7. The maximum building height shall not exceed 30 feet measured
from the top of the lowest foundation to the highest
ridgeline.
8. All utilities to the site shall be underground, including
Cable Television, telephone, electrical, gas and water. All
appropriate permits shall be obtained for their installation.
Cable Television shall connect to the nearest trunk line at
developer's expense.
9. The developer shall submit a set of plans to the Los Angeles
County Fire Department for their review and approval for
compliance with the Fire Code.

10. The variance for the use of tandem parking spaces on the site
shall become null and void if there is a substantial change
in the nature, type or degree of the use on the site which
would require additional parking as determined by the
Director of Environmental services.
11. The landowner shall record an Irrevocable Offer to Dedicate a
pedestrian/equestrian trail easement to the City for 20 feet
along the western and northern property line.
12. This approval shall expire one year from the date of the
Planning Commission action if application for building
permits for construction has not been made. Construction
must begin within one year of building permit application.
The Planning Commission may extend these time limits if so
requested prior to expiration.
