A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES APPROVING
WITH CONDITIONS VARIANCE NO. 174 LOCATED AT
32424 AQUA VISTA.
WHEREAS , Herbert and Tatiana Hyatt have requested a Variance
to allow an existing solid wall and wrought iron gates and posts
which exceed 42 inches within the 15 foot street side setback at
32424 Aqua Vista; and
WHEREAS , after notice pursuant to the City' s Development
Code , a public hearing was held on September 22 , 1987 , at which
time all interested parties were given an opportunity to be heard
and present evidence .
NOW, THEREFORE , THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS :
Section 1 : That there are exceptional or extraordinary
circumstances or conditions applicable to the property since it is
a corner lot next to a major vehicular arterial .
Section 2 : That a Variance is necessary to preserve or allow
the enjoyment of a substantial property right of the applicant
which is possessed by other property owners under similar
conditions in the same zoning district , since the alignment of
Palos Verdes Drive South is such that east bound traffic creates
excessive light and noise in the rear yard of the property.
Section 3 : That the granting of the Variance will not be
materially detrimental to the public welfare or injurious to
surrounding properties, since only a small portion of the wall is
over 5 feet in height and the majority of the wall is only a few
inches over the maximum 42 inch allowed height .
Section 4 : That the granting of the Variance will not be
contrary to the objectives of the General Plan, since it will
enhance the visual character and physical quality of the
neighborhood .
Section 5 : That as a condition of approval , a complete
landscape plan for the entire property that is consistent with the
Seacliff Hills Guidelines must be submitted to the Director of
Environmental Services for review and approval within 60 days .

Section 6 : For the foregoing reasons , the Planning
Commission of the City of Rancho Palos Verdes hereby approves
Variance No . 174.
APPROVED and ADOPTED the 13th day of October , 1987 .
