A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF RANCHO PALOS VERDES
APPROVING VARIANCE NO. 172 FOR A GAZEBO
AT 26608 HONEY CREEK ROAD.
WHEREAS, Duke and Alice Lin have requested a Variance to
allow an existing gazebo exceed the maximum allowed height by 2
feet 11 inches in an extreme (65%) slope at 26608 Honey Creek
Road.
WHEREAS, after notice pursuant to the City's Development
Code, a hearing was held on August 25, 1987, at which time all
interested parties were given an opportunity to be heard and
present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional or extraordinary
circumstances or conditions applicable to the property since the
back yard is fully developed and there are no other remaining
useable areas to locate the structure.
Section 2: That a Variance is necessary to preserve or allow
the enjoyment ^of a substantial property right of the applicant
which is possessed by other property owners under similar
conditions in the same zoning district, since the structure is a
use that is consistent with uses on other similar properties.
Section 3: That the granting of the Variance will not be
materially detrimental to the public welfare or injurious to
property and improvements in the area in which the property is
located, since the structure is barely visible from adjacent
properties, is screened by landscaping, and is a color and
materials which blends with the landscaping and the residence.
Section 4: That the granting of the Variance will not be
contrary to the objectives of the General Plan, as there are no
negative impacts since the structure enhances the physical and
visual character of the property and neighborhood and no grading
other than for the footings was associated with the structure.
Section 5: That, as a condition of approval, the existing
landscaping must be properly maintained to screen the structure.
Section 6: That, as a condition of approval, the structure
must be maintained with a color that blends with the natural
landscape, and is the same roofing material as the existing
residence.

Section 7: That, as a condition of approval, the structure
and access tothestructure conform to all building and safety
code requirements.
Section 8: For the foregoing reasons, the Planning
Commission of the City of Rancho Palos Verdes hereby approves
Variance No. 172.
