A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 159
AND GRADING NO. 1001 AT 2333 SPARTA DRIVE.
WHEREAS, Robert and Elizabeth McVey have requested a Variance
and Grading Permit to allow existing grading, downslope retaining
walls and a deck in an extreme slope at 2333 Sparta Drive; and
WHEREAS, after notice pursuant to the City's Development Code
a public hearing was held on August 11, 1987, at which time all
interested parties were given an opportunity to be heard and
present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional or extraordinary
circumstances or conditions that exist relative to this property
which do not apply generally to other properties in the same
district in that there is a level area midway down the slope where
the footings of a previous deck had been placed.
Section 2: That such Variance is necessary for the
preservation and enjoyment of substantial property right of the
applicant which right is possessed by others under like
circumstances in the same zoning district since other property
owners in the same residential district with level areas would be
allowed the same improvements.
Section 3: That the granting of such a Variance would not
result in adverse effects to the public welfare or the surrounding
development patterns as the deck structure and retaining walls are
not located in a Flood Hazard Area and will not result in view
impairment, visual impact, slope instability or increased runoff.
Section 4: That the granting of such a Variance will not be
contrary to the objectives of the General Plan in that said
project is not located in a Natural or Urban Overlay District.
Section 5: That the site cannot reasonably accommodate the
structure in another location involving an extreme slope.

Section 6: For the foregoing reasons, the Planning
Commission of the City of Rancho Palos Verdes hereby approved
Variance No. 159 and Grading No. 1001, subject to the conditions
in Exhibit "A".
APPROVED and ADOPTED this 11th day of August, 1987.

EXHIBIT "A"
VARIANCE NO. 159 AND GRADING NO. 1001
CONDITIONS OF APPROVAL
1. The applicant shall be required to submit geologic and
engineering studies to the City for review and approval prior
to any further activity.
2. The applicant shall reduce the height of the first and second
retaining walls to less than three feet by mounding the soil
in each planter or by another method approved by the Building
and Safety Division and the Director of Environmental
Services.
3. There shall -be a maximum of one downsloping retaining wall
with a maximum retention of 4 feet next to the existing
terrace and 3 feet 6 inches adjacent to the stairs and deck.
4. The applicant shall submit a landscape plan designed to
buffer the visual impacts of the deck and the exposed
portions of the downslope retaining wall from the properties
across the canyon. The high water use fruit trees shall be
removed and replaced with drought tolerant plant materials.
The landscape plan shall be subject to the approval of the
Director of Environmental Services.
5. The applicant shall reduce the size of the deck from 300
square feet to approximately 200 square feet.
6. At no time in the future shall the deck be covered or
enclosed in any manner, except for railing required by the
Building Code.
7. There shall be no electrical outlets or wiring installed on
the deck.
8. The deck and retaining walls shall be maintained in a color
that blends with the natural landscape of the canyon.
9. The conditions shall be met within 6 months of the date of
approval.
10. A handrail made of natural material and natural color shall
be added to the stairway with approval by the Director of
Environmental Services.
