RESOLUTION P.C. NO. 87 - 33
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING VARIANCE
NO. 163 AT 3333 PALOS VERDES DRIVE WEST FOR AN EXISTING
WALL AND A GARAGE.
WHEREAS , Mr. and Mrs . Bill Dwyer have requested a Variance to
allow an existing wall which exceeds 42 inches in the front
setback and a 9 foot reduction in the required 20 foot front
setback for a new garage at 3333 Palos Verdes Drive West .
WHEREAS , after notice pursuant to the City' s Development
Code , a hearing was held on July 14 , 1987 , at which time all
interested parties were given an opportunity to be heard and
present evidence .
NOW, THEREFORE , THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS :
Section 1 : That there are exceptional or extraordinary
circumstances or conditions applicable to the property since it is
a flag lot and difficult to locate as it is accessed off a street
other than the properties address , and the existing development of
the lot is inconsistent with the Code definition of property
lines .
Section 2 : That a Variance is necessary to preserve or allow
the enjoyment of a substantial property right of the applicant
which is possessed by other property owners under similar
conditions in the same zoning district , since the wall defines ,
identifies and protects the driveway entry area and is located on
the only level areas adjacent to the driveway.
Section 3 : That the granting of the Variance will not be
materially detrimental to the public welfare or injurious to
property and improvements in the area in which the property is
located , since the wall does not create a visibility or safety
hazard is constructed and designed with materials that match the
existing architecture on the site , and the garage will cause no
view blockage or privacy encroachment due to existing vegetation
and adjacent topography.
Section 4 : That the granting of the Variance will not be
contrary to the objectives of the General Plan, as there are no
negative impacts since the wall enhances the physical and visual
character of the property and neighborhood , is not detrimental to
the public health, safety and welfare, and the garage will allow
additional enclosed area for vehicular parking and will not be
visible to neighbors .

Section 5 : For the foregoing reasons , the Planning
Commission of the City of Rancho Palos Verdes hereby approves
Variance No . 163 .
APPROVED and ADOPTED this 14th day of July, 1987 .
