RESOLUTION P.C. NO . 87 - 32
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING VARIANCE
NO. 164 AND GRADING NO. 964 AT 3466 VIA CAMPESINA.
WHEREAS , Mr . Brad Frisselle has requested a Variance and
a Grading Permit to construct a two story single family
residence on a lot with an average slope of greater than 35%;
and
WHEREAS , after notice pursuant to the provision of the
Rancho Palos Verdes Development Code , a public hearing was
held on June 9 and July 14 , 1987 at which time all interested
parties were given an opportunity to be heard and present
evidence ;
NOW, THEREFORE , THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE
AS FOLLOWS :
Section 1 : That the configuration and topography of the
lot does not allow construction on a slope of less than 35% .
Section 2 : That there are exceptional or extraordinary
circumstances and conditions applicable to the property
involved which do not apply generally to the other properties
in the same zoning district , in that the lot was legally
created without a minimum buildable area with a slope of less
than 35%.
Section 3 : That approval of the Variance and Grading
Permit will not confer a special privilege on the land owner
in relation to similarly situated properties in the same
zoning district , in that the property is zoned for single
family residential development .
Section 4 : That approval of the Variance and Grading
Permit will not cause materially detrimental effects on
surrounding properties since the structure conforms with or
exceeds all Code height , setback and open space requirements .
Section 5 : That the Variance would not be contrary to
the General Plan.
Section 6: For the foregoing reasons, the Planning
Commission of the City of Rancho Palos Verdes hereby approves
Variance No. 164 and Grading No. 964 subject to the
conditions attached in Exhibit "A".
PASSED, APPROVED and ADOPTED this 14th day of July,
1987.

EXHIBIT "A"
VARIANCE NO. 164 AND GRADING NO. 964
3466 VIA CAMPESINA
1. Before any grading or building permits are issued, the
property owner shall record an Irrevocable Offer of
Dedication for a 25 foot equestrian trail easement along
the western property line of the subject project.
