RESOLUTION P.C. NO. 87- 25
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING VARIANCE
NO. 166.
WHEREAS, William and Maria Kupferschmidt have requested
a Variance to allow an existing deck, sauna, gazebo, spa and
slide to encroach 3 feet into the required side yard setback,
exceed the maximum allowed height by 5 feet 4 inches in an
extreme (55X) slope at 30240 Calle de Suenos.
WHEREAS, after notice pursuant to the City's Development
Code, a hearing was held on June 9, 1987, at which time all
interested parties were given an opportunity to be heard and
present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE
AS FOLLOWS:
Section l: That there are exceptional or extraordinary
circumstances or conditions applicable to the property since
the back yard is fully developed and there are no other
remaining useable areas to locate the structure.
Section 2: That a Variance is necessary to preserve or
allow the enjoyment of a substantial property right of the
applicant which is possessed by other property owners under
similar conditions in the same zoning district, since the
structure is a use that is consistent with uses on other
similar properties.
Section 3: That the granting of the Variance will not be
materially detrimental to the public welfare or injurious to
property and improvements in the area in which the property
is located, since the structures are not visible from
adjacent properties, are screened by landscaping, and are a
color which blends with the landscaping.
Section 4: That the granting of the Variance will not be
contrary to the objectives of the General Plan, as there are
no negative impacts since the structures enhance the physical
and visual character of the property and neighborhood and no
grading was associated with the structure.
Section 5: That as a condition of approval, the existing
landscaping must be properly maintained to screen the
structure.
Section 6: That as a condition of approval, the
structures must be maintained with a color that blends with

the natural landscape.
Section 7: For the foregoing reasons, the Planning
Commission of the City of Rancho Palos Verdes hereby approves
Variance No. 166.
