A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES DENYING
VARIANCE NO. 158
WHEREAS , Robert and Mary Ann Simon have requested a
Variance to allow an existing carport to encroach 4 feet 9
inches into the required side yard setback at 26843 Hyte
Road; and
WHEREAS , after notice pursuant to the City' s Development
Code , a public hearing was held on May 26 , 1987 , at which
time all interested parties were given an opportunity to be
heard and present evidence .
NOW, THEREFORE , THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE
AS FOLLOWS :
Section 1 : That there are no exceptional or
extraordinary circumstances or conditions applicable to the
size , shape , topography, development or location of the
subject property.
Section 2 : That a Variance is not necessary to preserve
or allow the enjoyment of a substantial property right of the
applicant which is possessed by other property owners under
similar conditions in the same zoning district , since the
applicant already has a two-car garage and existing setbacks
which are similar to other residences in the tract .
Section 3 : That the granting of the Variance will be
materially detrimental to the public welfare or injurious to
surrounding properties , since the carport is highly visible
does not screen the view of the mini-mobil home and does not
blend with the existing architecture .
Section 4 : That the granting of the Variance will be
contrary to the objectives of the General Plan, since it will
not enhance the visual character and physical quality of the
neighborhood .
Section 5 : For the foregoing reasons , the Planning
Commission of the City of Rancho Palos Verdes hereby denies
Variance No . 158 .
