A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES DENYING VARIANCE NO. 154
WHEREAS, Mr. Vincent Comparsi has requested a variance to
allow an approved second story addition to encroach into the
minimum rear setback of 15 feet by 6 feet at 2166 General
Avenue; and
WHEREAS, after notice issued pursuant to the provision of
the Rancho Palos Verdes Development Code, a public hearing
was held on April 14, 1987 at which time all interested
parties were given an opportunity to be heard and present
evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS
FOLLOWS:
Section l: That there are no exceptional or extraordinary
circumstances or conditions applicable to the property
involved which do not apply generally to other property in
the same zoning district; in that the subject lot is a
rectangular, graded pad.
Section 2: That said variance is not necessary for the
preservation and enjoyment of a substantial property right of
the applicant, which right is not possessed by other property
owners under like conditions in the same zoning district, in
that there is opportunity to add living space to the
residence and still respect minimum setback and open space
requirements.
Section 3: For the foregoing reasons, the Planning
Commission of the City of Rancho Palos Verdes hereby denies
Variance No. 154.
