A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES APPROVING AN
AMENDMENT TO CONDITIONAL USE PERMIT No. 33 ,
VARIANCE No. 145, AND GRADING No. 952
WHEREAS, Mr. and Mrs. Efrain D. Costales have made
application to construct a single-family dwelling on Lot 3 of
Tract No. 32110; and
WHEREAS, a hearing was held on February 24, 1987 at
which time the applicant and the Planning Commission
discussed the issues pertaining to this case.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE
AS FOLLOWS:
Section 1 : That there are exceptional or extraordinary
circumstances or conditions applicable to the property
involved, or to the intended use of the property which do not
generally apply to other properties in the same zoning
district, as the lot contains unusual topography and is
located on the ridgeline.
Section 2 : That such variance is necessary for the
preservation and enjoyment of a substantial property right of
the applicant, which right is possessed by the other owners
under like conditions in the same zoning district, as other
properties in Rancho Palos Verdes enjoy similar ridgeline to
lowest foundation heights .
Section 3 : That granting of the variance will not be
materially detrimental to the public welfare or injurious to
property and improvements in the area in which the property
is located as the addition is designed to fit into the
hillside which lessen its visual impact on surrounding
properties.
Section 4: That the granting of such a variance will not
be contrary to the objectives of the General Plan in that it
is encouraging reasonable development of the property without
impairing the views of neighboring properties or creating any
safety hazards.
Section 5: That the grading for the residence conforms
to the Development Code of Rancho Palos Verdes.
Section 6 : The site is adequate to place the proposed
single-family dwelling unit.

Section 7 : That the proposed building footprint conforms
with the City' s Development Code Standards relating to
setbacks and lot coverage.
Section 8 : For the foregoing reasons , the Planning
Commission of the City of Rancho Palos Verdes hereby grants
this amendment to Conditional Use Permit No. 33, Grading
Application No. 952, and Variance No. 145 subject to the
conditions contained in Exhibit "A" attached hereto.

EXHIBIT "A"
1. That the residence maintains the following setbacks:
27 ' front
18 ' side (west)
51 ' side (east)
54 ' rear
2. That the color of the siding and roof are approved by
the Environmental Services Department to blend the
residence with the abutting natural preserve.
3. That any other increases of lot coverage or exterior
additions or accessory structures require a CUP revision
4. That a landscape plan is submitted and approved by the
Director of Environmental Services that utilizes plant
materials that are drought tolerant to the extent
possible and does not cause view blockage to any
surroundings properties.
5. That the fence located in the first 20 feet from the
front property line is lowered to 42" .
6. That the deck area that lies in the rear setback that is
6" or greater in height is lowered to less than 6" .
7. That no development or grading, or disruption occurs
to slope areas greater than 35%.
