RESOLUTION P.C. NO. 87 - 7
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES MODIFYING
CONDITION NO. 16 OF RESOLUTION P.C. NO. 86-15
WHEREAS, Mr. Ken Tabatabay has requested that the scope of public
improvements required under Conditional Use Permit No. 103 be reduced; and
WHEREAS, Section 17.46.040 of the City's Development Code requires
the scope and costs of said improvements to be reduced (to reflect improvements
to centerline and along property frontage) ; and
WHEREAS, the Director of Public Works, in reviewing Mr. Tabatabay's
request has determined that certain improvements could be eliminated and others
should have been required with initial approval of Conditional Use Permit No. 103
but were not; and
WHEREAS, the Planning Commission conducted a hearing on Tuesday, January
27, 1987 to consider this request, at which time all interested parties were
invited to give testimony and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That Chapter 17.46 of the City's Development Code entitles
the City to require off-site improvements which are necessary and lacking along
the street frontage of any lot, at the time of any construction done on the lot.
Section 2: That Condition No. 16 of Resolution P.C. No. 86-15, approving
Conditional Use Permit 103, Variance No. 132 and Grading No. 859 shall be amended
to read as follows:
16) The developer of the project shall post a cash deposit, a bond
or combination thereof in an amount to be determined by the
Director of Public Works to cover the costs of the following
public improvements:
a. Red curbing along Crest Road between the project
driveway and Hawthorne Boulevard.
b. Overlay of the west side of Hawthorne Boulevard to the
centerline along the length of the frontage.
c. Closure of existing driveway on Hawthorne Boulevard
and installation of new curb and gutter.
d. Install a new 6 inch thick concrete sidewalk on
Crest Road from Hawthorne Boulevard to end of
property.

e. Repair any damaged sidewalk along the Hawthorne Boulevard
frontage.
f. Landscape and irrigate parkways along the Hawthorne Boule-
vard and Crest Road frontages.
g. Striping, marking and signing of a Class II bike path
along the Hawthorne Boulevard frontage.
h. Install a new wheelchair ramp on the northwest corner of
Hawthorne Boulevard and Crest Road.
i. One quarter of potential signalization improvements at
Crest Road and Hawthorne Boulevard.
j. One half of potential median in Crest Road between the subject
site and Hughes Market, along the Crest Road frontage.
k. The securities for the improvements listed in items (a) - (j)
above shall be provided to the City prior to the issuance
of a Certificate of Occupancy on the building shell.
Securities for items (i) and (j) shall be held for a
5-year period; should the City not implement these
improvements in that time period, the securities shall be
released.
Section 3: That the off-site improvements, as listed in Section 2,
above, are necessary to assure public safety in access to and use of the facilities
being constructed.
Section 4: For the foregoing reasons, the Planning Commission of the
City of Rancho Palos Verdes hereby amends Condition No. 16 of Resolution P.C.
No. 86-15, as specified in Section 2.
