PC RES 1987-004 RESOLUTION P.C. NO. 87 - 4 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 151 WHEREAS, the applicant, Fred Arkenburg, has requested approval of Variance No. 151 for reduced parking standards for a 6,936 square foot commercial retail building located at 29409 Western Avenue; and WHEREAS, the Planning Commission of the City of Rancho Palos Verdes conducted a public hearing for this application on January 13, 1987 at which time all interested parties were given an opportunity to testify and present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional circumstances and conditions applicable to the subject property which do not generally apply to other properties in the same zoning district, since less restrictive parking standards have been adopted for an adjacent commercial area with the same zoning classification and similar uses and the same standard is expected to be adopted for Specific Plan IV where the subject property is located. Section 2: That the variance is necessary for the preservation and enjoyment of a substantial property right, which right is enjoyed by other property owners under like conditions in the same zoning district, in that adjacent properties in Specific Plan III are allowed to use the smaller standard parking stall dimensions. Section 3: That the granting of the variance will not be materially detrimental to the public welfare, or injurious to property and improvements in the area, since the Conditions of Approval in Exhibit "A" will mitigate potential impacts. Section 4: That the granting of the variance will not be contrary to the objectives of the General Plan. Section 5: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes does hereby approve Variance No. 151 subject to the conditions contained in Exhibit "A", attached hereto and made a part hereof, which are necessary to preserve the public health, safety and general welfare in the area.
