A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES APPROVING CONDITIONAL USE PERMIT NO. 99
WHEREAS, T.W. Layman Associates has requested approval of CUP No.
99 to construct a one story, 6,098 square foot (net), multi-tennant retail
building to be located at the southwest corner of Western Avenue and Crestwood
Street; and
WHEREAS, after notice pursuant to the Development Code, a public hearing
was held on Tuesday, December 9, 1986, at which time all interested parties
were given the opportunity to give testimony and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there will be no significant adverse environmental
impacts resulting from this project, as it has been determined to be
Categorically Exempt under Section 15303, Class 3, of CEQA.
Section 2: That the granting of the Conditional Use Permit will
not be contrary to the objectives of Specific Plan III or of the General Plan
in that the proposed use complies with Specific Plan III, the General Plan
and zoning land use designations.
Section 3: That the subject site is adequate in size and shape to
accommodate the intended use, subject to the conditions of approval contained
in Exhibit "A", attached hereto.
Section 4: That the site is serviced by Western Avenue and Crestwood
Street, whose traffic capacity is adequate to serve the site without suffering
significant impacts to their level of service.
Section 5: For the foregoing reasons, the Planning Commission of
the City of Rancho Palos Verdes does hereby approve Conditional Use Permit
No. 99 subject to the conditions contained in Exhibit "A", attached hereto
and made a part hereof, which are necessary to preserve the public health,
safety and general welfare in the area.

EXHIBIT "A"
Conditional Use Permit No. 99 is approved subject to the following conditions:
1) This approval shall expire one year from the date of this action unless
application for building permits is made. Extensions may be granted by
the Planning Commission if requested prior to expiration.
2) All of the recommendations made by the City Engineer, the City Geologist
and the Consulting Geologist resulting from their review of the project
shall be incorporated into the approved plans.
3) Detailed landscape and irrigation plans, consistent with the criteria in
Specific Plan III, shall be submitted for review and approval to the Director
of Environmental Services prior to issuance of any permits. Said plans
shall incorporate drought tolerant plant materials. Irrigation systems
shall be on automatic timers and shall use drip and bubbler systems where
appropriate. Hillside plant material shall be of low maintenance and low
water use varieties. Irrigation systems shall be adjusted for seasonal
water needs. A large percentage of mature vegetation shall be incorporated
into the plans.
4) Final construction plans for the proposed buildings shall be in conformance
with the plans approved by the Planning Commission, including heights and
setbacks. Colors and materials shall conform to those indicated on the
building elevations and site plan. Lighting details and locations for
areas to be lit, trash receptacles and telephones (if any) shall be shown
on the landscaping plans. The concrete walkway in front of the stores
shall match the driveway apron material and color.
5) Sign permits shall be obtained for all signs from the Environmental Services
Department. All signs shall conform to the Sign Program reviewed and
approved by the Planning Commission. A color pallete for said Sign Program
shall be provided. Sign colors shall be compatible to building colors
subject to review and approval of the Director of Environmental Services.
6) Trash enclosure walls shall be 6 feet high and shall have solid, self-closing
gates. Colors and materials shall be compatible with the building.
7) All utilities exclusively serving the site shall be provided underground,
including Cable Television, telephone, electrical, gas and water. All
appropriate permits shall be obtained for their installation. Cable
Television shall connect to the nearest trunk line at developer's expense
when available.
8) All roof mounted mechanical equipment, vents or ducts shall be screened
and covered as necessary so as to reduce their visibility from adjacent
properties and public rights-of-way. Any necessary screening and covering
shall be architecturally harmonious with the materials and colors of the
buildings.
9) Maximum lot coverage (building footprint) shall not exceed 507.

10) The project shall have, as a minimum,30 parking spaces and 2 bicycle spaces.
11) Deliveries shall be limited to the hours of 7:00 a.m. to 6:00 p.m. Monday
through Friday, and 8:00 a.m. to 6:00 p.m. on Saturday and Sunday.
12) Construction activities shall be limited to the hours of 7:00 a.m. to
4:30 p.m. Monday through Friday, and 8:00 a.m. to 4:30 p.m. on Saturdays;
except that interior and/or exterior finish work not involving heavy
equipment, shall be permitted until 7:00 p.m. Monday through Saturday.
No construction activity shall occur on Sundays without the prior written
approval of the Director of Environmental Services.
13) All mechanical equipment shall be housed in enclosures designed to attenuate
noise to a level of 45dBA at the rear property line (as necessary) . This
shall be verified by a field test prior to issuance of certificates of
occupancy. Mechanical equipment for restaurants shall incorporate filtration
systems to eliminate all exhaust odors.
14) All site runoff/drainage shall be approved by the City Engineer and
conducted to existing storm drain systems, via methods approved by the
City Engineer and Director of Public Works. Any concrete drainage swales
shall be earth toned in color.
15) Hours of business operation (open to public-close to public) shall be
limited to 7:00 a.m. through 11:00 p.m.
16) Lot sweeping, use of air blowers and garbage collection shall not occur
between the hours of 10:00 p.m. and 7:00 a.m.
17) Parking and security lighting shall be kept to minimum safety standards.
Fixtures shall be shielded so that only the subject property is illuminated;
there shall be no spillover onto residential properties.
18) Any use which sells alcoholic beverages for off-site consumption shall
require an amendment to this Conditional Use Permit.
19) Mini or convenience markets shall be prohibited. Upon adoption of a City
ordinance establishing standards for such uses, the applicant may process
an amendment to CUP 99 to allow such uses.
20) The following applications shall be made to Caltrans for improvements on
Western Avenue:
a) Red curbing at driveways & intersection corners on Western Avenue for
site distance.
b) Class II Bicycle path.
c) Median improvements in Western Avenue (placement of bomanite) .

d) Securities shall be posted for items a, b, and c for a period not exceed
five years. Such securities shall be released upon completion of work
denial of application, or expiration of the five year time limit, which-
eer comes first.
