A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING THE FINAL
NEGATIVE DECLARATION FOR E.A. NO. 489, CUP NO. 106
AND S.P. NO. 305
WHEREAS, Ms. Felicia Wilson has requested approval of E.A. No. 489,
CUP No. 106 and Sign Permit No. 305 to allow an existing jazzercise fitness
center to remain along with nonconforming signage at 29625 South Western
Avenue; and
WHEREAS, after notice pursuant to the Development Code, public hearings
were held on Tuesday, September 30, and October 28, 1986 at which time all
interested parties were given an opportunity to give testimony and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there will be no significant environmental impacts
resulting from the proposed use due to the implementation of the mitigation
measures attached to the Final Negative Declaration for E.A. No. 489, which
have been incorporated into the conditions of approval in Exhibit A, which
is attached hereto and made a part hereof.
Section 2: That the site for the intended use is adequate in shape
and sizeto accommodate said use, because the exclusive use of additional
off-street parking has been obtained and classes do not overlap as required in
the conditions contained in Exhibit A attached hereto.
Section 3: That the site is served for access by Western Avenue,
which is capable of handling the traffic generated by said use without suffering
in a decline in existing levels of service.
Section 4: That said use will not result in significant adverse
impacts on adjacent properties, providing that requirements contained in
Exhibit A attached hereto, are satisfied.
Section 5: That said use is not contrary to the General Plan.

Section 6: For the foregoing reasons, the Planning Commission
of the City of Rancho Palos Verdes does hereby approve the Final Negative
Declaration for E.A. No. 489, CUP 106, and Sign Permit No. 305; subject
to the conditions contained in Exhibit A attached hereto and made a part
hereof, which are necessary to preserve the public health, safety and general
welfare.

EXHIBIT A
The Final Negative Declaration for E.A. No. 489, CUP NO. 106 and Sign Permit
No. 305 are approved subject to the following conditions:
1. The applicant shall provide an agreement(s) which documents the availability
of additional off-street parking spaces (for the exclusive use of Ship Shape
Center) for a total of 15 spaces (including 7 on site) . Said spaces shall
be no more than 400 feet from Ship Shape Center. Said agreement(s) shall be
provided to the City within 60 days of the date of this approval, and shall
run concurrently with the length of lease for the Ship Shape Center.
The applicant shall request an extension of CUP 106 on an annual basis based
on the one-year lease arrangements. The Planning Commission may renew
CUP 106 predicated upon the ability to maintain the 15 parking spaces noted
above.
2. Classes shall be scheduled a minimum of 30 minutes apart.
3. Class sizes shall not exceed a maximum of 40 students per class.
4. The existing building mounted cannister sign shall be reduced to a maximum
area of 42 square feet.
5. The existing pole sign shall be removed no later than June 24, 1990
(end of the amortization period for this center) .
6. Noncompliance with any of the above conditions may result in the City
bringing this CUP up for review and reconsideration.
