A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES DENYING VARIANCE
NO. 146 AT 2345 SPARTA DRIVE.
WHEREAS, Mr. Robert DeLossa has requested a variance to allow
construction of an accessory structure on an extreme slope at 2345 Sparta
Drive; and
WHEREAS, after notice issued pursuant to the provision of the Rancho
Palos Verdes Development Code, a public hearing was held on Wednesday, November
12, 1986, at which time all interested parties were given an opportunity to
be heard and present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there are no exceptional or extraordinary
circumstances or conditions applicable to the property involved which do not
apply generally to other property in the same zoning district, in that the
subject lot exceeds the minimum size requirements for this zone, and has a
large pad area and the house does not encroach into the extreme slope.
Section 2: That said Variance is not necessary for the preservation
and enjoyment of a substantial property right of the applicant, which right
is not possessed by other property owners under like conditions in the same
zoning district; in that the size, configuration and topography of the lot
is similar to other lots in the same tract and older pad lots found throughout
the zoning district.
Section 3: That the granting of such a variance will be materially
detrimental to surrounding properties since the terracing and the proposed
structure would be visible and obstrusive to surrounding properties and will
have an adverse effect on the integrity of the canyon in which the property
is located.
Section 4: That the granting of such a variance will be contrary
to the objectives of the General Plan since the property is lcoated in a
sensitive area and is subject to potential flash flooding and has natural
topography and vegetation that contribute to the open, hilly character of
the city and its environment.
Section 5: For the foregoing reasons, the Planning Commission of
the City of Rancho Palos Verdes hereby denies Variance No. 146.
