A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES APPROVING A REVISION TO CONDITIONAL
USE PERMIT NO. 37, VARIANCE NO. 148, COASTAL PERMIT NO.
25, AND GRADING APPLICATION NO. 949.
WHEREAS, Marineland has made application to remodel and expand the
existing Sea Mammal Stadium, add filtration tanks and tide pools, expand holding
tanks, and improve outdoor dining areas, including trellises, at 6610 Palos
Verdes Drive South; and
WHEREAS, after notice pursuant to the Development Code, a public
hearing was held on Wednesday, November 12, 1986, at which time all interested
parties were invited to give testimony and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That the site is adequate .in size and shape to accommodate
the proposed improvements.
Section 2: That the site is accessed by Palos Verdes Drive South,
a major arterial, which is capable of handling all traffic directed to this
use.
Section 3: That the design of the proposed improvements reduces
or eliminates any impacts on surrounding properties in that noise will be
directed away from nearby residential uses, and proposed structures will not
result in adverse impacts on views.
Section 4: That there are exceptional or extraordinary circumstances
applicable to the subject properties which justify trellis structures within
the required 25' coastal setback zone, which do not apply generally to other
properties in the same zoning district; in that the subject property is the
only Commercial Recreational zoned property in the City, and the proposed
trellises would provide shade in an area used for viewing the coastal bluffs
and Pacific Ocean.
Section 5: That this variance is necessary for the enjoyment and
preservation of a substantial property right which right is enjoyed by members
of the public at large and which is enjoyed in no other zone in the City; in
that the trellises would allow for outdoor public viewing and dining in a shaded
area on the coastal bluffs.
Section 6: The granting of the variance would not be detrimental
to surrounding properties because the proposed trellises would not be visible
to surrounding properties.
Section 7: The proposed project, including trellises, is not contrary
to the General Plan or Coastal Specific Plan; in that public activities at
or near the coast would be enhanced.
Section 8: That the proposed grading for the project is minimal
and meets the intent of the Development Code.
Section 9: That the proposed project is Categorically Exempt subject
to the guidelines contained in the California Environmental Quality Act, and
would not result in any significant, adverse environmental impacts.
Section 10: For the foregoing reasons, the Planning Commission of
the City of Rancho Palos Verdes does hereby approve a revision to Conditional
Use Permit No. 37, Variance No. 148, Coastal Permit No. 25 and Grading No.
949, subject to the conditions contained in Exhibit "A" attached hereto and
made a part hereof, which have been deemed necessary to protect the public
health, safety and general welfare in the area.

EXHIBIT "A"
The revision to Conditional Use Permit No. 37, Variance No. 148, Coastal Permit No.
25 and Grading Application No. 949 are approved subject to the following conditions:
1. This approval shall expire one year from the date of adoption of this resolution.
One, one year extension may be granted by the Planning Commission if requested
prior to expiration.
2. Detailed landscape and irrigation plans, with hardscape designs, shall be submitted
to the Director of Environmental Services for review and approval prior to issuance
of building permits. Said plans shall incorporate a high percentage of low-water
use plant materials. Irrigation systems shall be on automatic timers which shall
be adjusted for seasonal water needs, and shall incorporate bubbler heads where
appropriate.
3. The trellis structure shall not exceed 12 feet in maximum height.
4. Runoff from hard surfaced terrace areas shall be collected via area drains. Said
runoff shall not be allowed to flow over the bluffs in an uncontrolled manner.
5. The City Engineer and City Geologist shall review and approve all drainage and
grading plans.
6. The location, height and design of all improvements shall conform to the plans
date-stamped October 17, 1986 (by the City) and reviewed and approved by the
Planning Commission. Any proposed changes or modifications shall be reviewed
and approved by the Director of Environmental Services prior to implementation.
7. A lighting plan indicating the number, type, location and light patterns of any
proposed lighting shall be submitted for review and approval by the Director of
Environmental Services.
8. All required clearances and/or approvals, and/or permits shall be obtained from
all agencies having jurisdiction of this project.
