A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES APPROVING THE FINAL NEGATIVE
DECLARATION FOR ENVIRONMENTAL ASSESSMENT NO. 477,
CONDITIONAL USE PERMIT NO. 101 AND GRADING NO. 950.
WHEREAS, Roderick Property Holdings, Inc. has requested approval
of the Final Negative Draft Declaration for Environmental Assessment No. 477,
Conditional Use Permit No. 101 and Grading No. 950 to expand and rennovate
the Harbor Heights shopping center located at the southwest corner of Western
Avenue and Caddington Drive.
WHEREAS, after notice pursuant to the Development Code, public hearings
were held on Tuesday, September 30, and Tuesday October 14, 1986, at which
time all interested parties were given the opportunity to give testimony and
present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES
DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there will be no significant environmental impacts resulting
from this project due to the implementation of the mitigation measures contained
in the Final Negative Declaration for Environmental Assessment No. 477, which
have been incorporated into conditions of approval in Exhibit "A", attached
hereto and made a part hereof.
Section 2: That the granting of the Conditional Use Permit will not be
contrary to the objectives of Specific Plan II or of the General Plan in that
the proposed use complies with Specific Plan II, the General Plan and zoning
land use designations.
Section 3: That the subject site is adequate in size and shape to accommodate
the intended use, subject to the conditions of approval contained in Exhibit
"A", attached hereto.
Section 4: That the site is serviced by Western Avenue and Caddington
Dr. , whose traffic capacity is adequate to serve the site without suffering
significant impacts to their level of service, and the applicant has been required
in Exhibit "A" attached hereto, to bond for left-turn signalization of the
Western Avenue and Caddington Drive intersection.
Section 5: That the proposed grading meets the intent of the City's grading
criteria contained in the Development Code and is not excessive in terms of
the proposed development of the site.
Section 6: For the foregoing reasons, the Planning Commission of the
City of Rancho Palos Verdes does hereby approve the Final Negative Declaration
for E.A. No. 477, Conditional Use Permit No. 101 and Grading No. 950 subject
to the conditions contained in Exhibit "A", attached hereto and made a part
hereof, which are necessary to preserve the public health, safety and general
welfare in the area.

EXHIBIT "A"
The Final Negative Declaration for Environmental Assessment No. 477, Conditional
Use Permit No. 101 and Grading Application No. 950 are approved subject to
the following conditions:
1) These approvals shall expire one year from the date of this action
unless application for building permits is made. One, one-year extension
may be granted by the Planning Commission if requested prior to expiration.
2) All of the recommendations made by the City Engineer and the City Geologist
during their ongoing review of the project shall be incorporated into
the approved plans.
3) Detailed landscape and irrigation plans shall be submitted for review
and approval to the Director of Environmental Services prior to issuance
of any permits. Said plans shall incorporate drought tolerant plant materials.
Irrigation systems shall be on automatic timers and shall use drip and
bubbler systems where appropriate. Hillside plant materials shall be
of low maintenance and low water use varieties. Irrigation systems shall
be adjusted for seasonal water needs. Existing mature palm trees on-site
shall be saved and re-used in the new landscaping. A large percentage
of mature vegetation shall be incorporated into the plans.
4) Final construction plans for the proposed buildings shall be in substantial
conformance with the plans approved by the Planning Commission, including
heights and setbacks. Colors and materials shall conform to those provided
on the colored renderings reviewed with this project. Final plans shall
include lighting details, locations for areas to be lit, bicycle racks,
fountains and pedestrian seating.
5) Sign permits shall be obtained for all signs from the Environmental Services
Department. All signs shall conform to the Sign Program reviewed and
approved by the Planning Commission. A color pallete for said Sign Program
shall be provided. Sign colors shall be compatible to building colors
subject to review and approval of the Director of Environmental Services.
6) Trash enclosure walls shall be 6 feet high and shall have solid, self-closing
gates.
7) All utilities exclusively serving the site shall be provided underground,
including Cable Television, telephone, electrical, gas and water. All
appropriate permits shall be obtained for their installation. Cable Television
shall connect to the nearest trunk line at developer's expense when available.
8) All roof mounted mechanical equipment, vents or ducts shall be screened
and covered as necessary so as to reduce their visibility from adjacent
properties and public rights-of-way. Any necessary screening and covering
shall be architecturally harmonious with the materials and colors of the
buildings.
9) Maximum lot coverage (building footprints) shall not exceed 5070.

10) The project shall have, as a minimum, 819 parking spaces with a maximum
of 20% as compact spaces.
11) Deliveries shall be limited to the hours of 7:00 a.m. to 6:00 p.m. Monday
through Friday, and 8:00 a.m. to 6:00 p.m. on Saturday and Sunday.
12) Construction activites shall be limited to the hours of 7:00 a.m. to 4:30
p.m. Monday through Friday, and 8:00 to 4:30 p.m. on Saturdays; except
that interior and/or exterior finish work not involving heavy equipment,
shall be permitted until 7:00 p.m. Monday through Saturday. No construction
activity shall occur on Sundays without the prior written approval of
the Director of Environmental Services.
13) All mechanical equipment shall be housed in enclosures designed to attenuate
noise to a level of 45dBA to the rear property line (as necessary). Changes
in use, by unit in the existing building, shall require consolidation
of mechanical equipment. No exterior ducting shall be allowed with new
equipment. Mechanical equipment for restaurants shall incorporate filtration
systems to eliminate all exhaust odors.
14) Paving surfaces on driveway ramps and parking areas shall be of a type
which will retard tire noise.
15) Prior to issuance of grading permits, the applicant shall submit a legal
(by licensed surveyor) and photographic survey of adjacent residential
properties so as to establish their property lines and on-site conditions.
16) All site runoff/drainage shall be approved by the City Engineer and conducted
to existing storm drain systems via methods approved by the City Engineer
and Director of Public Works. Concrete drainage swales shall be earth
toned in color.
17) The total net leaseable floor area shall not exceed 192,682 square feet.
A maximum of 27,939 square feet of net leaseable area shall be allowed
for non-retail uses; such uses shall be subject to the determination of
the Director of Environmental Services.
18) Hours of business operation (open to public-close to public) shall be
limited to 7:00 a.m. through 12:00 midnight; however, food and beverage
uses and theatres may be open to the public until 2:00 a.m.
19) Lot sweeping, use of air blowers and garbage collection shall not occur
between the hours of 10:00 p.m. and 7:00 a.m.
20) Parking and security lighting shall be kept to minimum safety standards.
Fixtures shall be shielded so that only the subject property is illuminated;
there shall be no spillover onto residential properties.
21) The following applications shall be made to Caltrans for improvements on
Western Avenue:
a) Signal at the median break opposite southernmost driveway.

b) Left-turn signals for all directions on Western Avenue/Caddington
Drive intersection.
c) Red curbing at driveways and intersection corners on Western Avenue
for site distance.
d) Third traffic lane for peak A.M. and/or P.M. traffic hours.
e) Class II Bicycle path.
f) Securities shall be posted for items (a) - (e) above, for a period
not to exceed three years. Such securities shall be released upon
completion of work, denial of application, or expiration of the three
year time limit, whichever comes first.
22) On-site directory signage shall be provided to facilitate pedestrian
and vehicular circulation. Colors and materials of such signs shall
be harmonious with building materials. This signage shall be part
of a comprehensive sign program for the site.
23) Any use which sells alcoholic beverages for off-site consumption
shall require an amendment to this Conditional Use Permit.
