A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES GRANTING A REVISION TO CONDITIONAL USE PERMIT
NO. 104 FOR A JOINT USE RECREATIONAL FACILITY.
WHEREAS, Mr. Josef Kubicek and Mr. Ben Karmelich have filed application
for a revision for a joint use recreational facility, on lots 24 and 25 of
Record of Survey 64-10, 18 and 19 La Vista Verde, Rancho Palos Verdes; and
WHEREAS, after notice required by the Development Code a public hearing
was duly held on September 23, 1986 at which time all interested persons were
given a full opportunity to be heard and to present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: Said real property is in the RS-2 District, and the proposed
use is permitted therein by conditional use permit pursuant to Section 17.56.020
of the Development Code.
Section 2: The site, totaling 82,430 square feet is adequate in
size and shape to accommodate the recreational facility. The two lots, at
58,370 and 24,060, exceed the minimum lot size (20,000 square feet) required
in the RS-2 District.
Section 3: The site is adequately served by the existing street
and highway system, since the proposed use is accessory to the primary use,
which is single family residential.
Section 4: Based upon the evidence presented, the facility will
not adversely affect the adjacent property or the permitted use thereof.
Section 5: The proposed use is not contrary to the General Plan,
which encourages private recreation facilities in appropraite locations.
Section 6: For the foregoing reasons, the Planning Commission of
the City of Rancho Palos Verdes hereby grants a conditional use permit to allow
a joint tennis court on said real property subject to the following conditions
contained in Exhibit "A" which conditions are deemed necessary to protect t e
health, safety and general welfare in the District.

EXHIBIT "A"
The following conditions are added to the Conditional Use Permit 104 Revision:
1. That a survey be performed at the properties that is certified by a registered
civil engineer or licensed surveyor to determine the actual location of
the tennis court, associated structure and access easements. If it is
determined that the structure straddles the property line, the applicant
should be required to file for a lot line adjustment that would ensure
that the structure is located entirely on #18 La Vista Verde and respects
the required side and rear setbacks, within 60 days.
2. That legal document, should be submitted and approved by the City Attorney
within 60 days that should address the following issues:
A. Continued guaranteed access from #19 La Vista Verde to #18 La Vista
Verde.
B. Continued use arrangements.
C. Reciprocal easements for the tennis court and structure on #19 La Vista
Verde and #18 La Vista Verde.
3. Revision to condition F of the original Conditional Use Permit.
The court shall be treated with a non-glare, earth-tone colored surface
(i.e. , standard brown and green) within one year of Planning Commission
approval.
4. Revision to condition J of the original Conditional Use Permit.
The existing carport shall be replaced with two enclosed garage parking
spaces within 12 months of Planning Commission approval. Such construction
is subject to City permit requirements.
5. Revision to condition K of the original Conditional Use Permit.
Three "NO SMOKING" signs, 1 X 3 feet in size, shall be posted in conspicuous
places around the tennis court and storage room within 60 days of Planning
Commission Approval.
6. Revision to condition L of the original Conditional Use Permit.
The applicant shall agree, in writing, within 60 days, to this resolution
and conditions, and, in partial consideration for the issuance of such,
shall record such conditions as running with land.
7. Require the applicant to file requests within 60 days that the City Council
modify its conditions of approval for Site Plan Review No. 3378 and that
the Planning Commission modify their conditions for Variance No. 131.
