A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES APPROVING VARIANCE NO. 138
WHEREAS, John and Leslie Sirianni have requested a Variance to
allow an existing deck built without permits in the required rear and side
setbacks to remain at 29610 Enrose Avenue, Rancho Palos Verdes, and;
WHEREAS, after notice pursuant to the City's Development Code, a
public hearing was held on September 9, 1986 at which time all interested
parties were given an opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: There are exceptional and extraordinary circumstances
relating to the size, shape and topography of the subject property which
prevent the development of the property in conformance with the Development
Code since the property is smaller than the minimum lot size and narrows
in the rear yard with an extreme slope at the rear of the residence which
limit the useable rear yard area.
Section 2: That a variance is necessary for preservation and
enjoyment of a substantial property right of the applicant that is possessed
by other property owners under similar conditions in the same zoning district
since the deck is necessary to allow the property owner reasonable recreational
use of the rear yard.
Section 3: That granting of such a variance would not be materially
detrimental to surrounding properties- since the structure is not visible
or obtrusive to surrounding properties and has no adverse effect on those
properties or views.
Section 4: That the granting of such a variance will not be contrary
to the objectives of the General Plan.
Section 5: For the foregoing reasons, the Planning Commission
of the City of Rancho Palos Verdes hereby approves Variance No. 138 and di
the applicants to apply for building permits.
