A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF RANCHO PALOS VERDES APPROVING
VARIANCE NO. 139
WHEREAS, Ralph Wood has requested a variance to allow a deck enclosure to
encroach up to twenty-three (23) feet into the required thirty (30) foot street set-
back at 31250 Palos verdes Drive West (the Admiral Risty Restaurant); and
WHEREAS, after notice pursuant to the City's Development Code a public
hearing was held on August 26, 1986, at which time all interested parties were
given an opportunity to be heard and present evidence
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES
DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional or extraordinary circumstances or
conditions that exist relative to this property which do not apply generally to other
properties in the same district as the restaurant building existed prior the adoption
of the setback and parking ordinances, and the proposed enclosure will not encroach
further into the existing street setback than the remaining structures.
Section 2: That such variance is necessary for the preservation and enjoyment
of substantial property right of the applicant which right is possessed by others
under like circumstances in the same zoning district since other property owners
in the same commercial district with proper setbacks and adequate parking facilities
would be allowed the same improvements.
Section 3: That the granting of such a variance would not result in adverse
effects to the public welfare or the surrounding development patterns as the proposed
structure will not interfere with future and/or adjacent developments as the increased
demand for parking spaces will be mitigated by the different hours of use at the
Golden Cove Shopping Center.
Section 4: That the granting of such a variance will not be contrary
to the objectives of the General Plan in that said plan encourages reasonable
development of the property without interfering with future and adjacent development
patterns or creating any safety hazards.
Section 5: For the foregoing reasons, the Planning Commission of the City of
Rancho Palos Verdes hereby approves Variance 139, subject to the conditions
in Exhibit "A".

EXHIBIT "A"
Variance No. 139 is approved subject to the following condition:
1. Within one year for the date of this decision or prior to occupancy,
whichever is sooner, trash enclosures shall be provided on the site
at a location and of a size and configuration approved by the
Environmental Services Director, based on applicable code requirements.
