RESOLUTION P.C. NO. 86 - 17
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING VARIANCE
NO. 136
WHEREAS, Dr. Jayatilaka has requested a variance to allow a
solarium addition which encroaches up to six (6) feet, six (6) inches into
the required twenty (20) foot front setback at 3462 Via Campensina; and
WHEREAS, after notice pursuant to the City's Development Code a
public hearing was held on August 12, 1986, at which time all interested parties
were given an opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional or extraordinary circumstances
or conditions applicable to the property involved, wherein the configuration
of the lot is unique and the residence is located in such a way that the
designated front setback functions as a side yard.
Section 2: That such variance is necessary for the preservation and
enjoyment of a substantial property right of the applicant, to utilize
the yard area that is located to the side of the residence, which right
is possessed by other owners under like conditions in the same zoning district,
as other properties in the surrounding area enjoy a similar encroachment in the
same circumstance.
Section 3:. That granting of the variance will not be materially
detrimental to the public welfare or injurious to property and improvements
in the area in which the property is located as the addition is designed to
lessen its impact on surrounding properties.
Section 4: That the granting of such a variance will not be
contrary to the objectives of the General Plan in that it is encouraging reasonable
development of the property without impairing the views of neighboring properties
or creating any safety hazards.
Section 5: For the foregoing reasons, the Planning Commission of the
City of Rancho Palos Verdes hereby approves Variance No. 136.
