PC RES 1986-015 RESOLUTION P.C. NO. 86-15 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING THE FINAL NEGATIVE DECLARATION FOR ENVIRONMENTAL ASSESSMENT NO. 482, CONDITIONAL USE PERMIT NO. 103, VARIANCE NO. 132, AND GRADING APPLICATION NO. 859. WHEREAS, the applicant, Ken Tabatabay, has requested approval of Final Negative Declaration for Environmental Assessment No. 482, Conditional Use Permit No. 103, Variance No. 132, and Grading Application No. 859 for reduced parking standards and setbacks for a 12,098 square foot office building located at 29941 Hawthorne Boulevard; and WHEREAS, the Planning Commission of the City of Rancho Palos Verdes has conducted public hearings for these applications on March 25 and June 10, 1986 at which time all interested parties are invited to give testimony and present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That there will be no significant environmental impacts resulting from this project due to the implementation of the mitigation measures attached to .the Final Negative Declaration for Environmental Assessment No. 482, which have been incorporated into conditions of approval in Exhibit "A", attached hereto and made a part hereof. Section 2: That there are exceptional circumstances and conditions applicable to the subject property which do not generally apply to other properties in the same zoning district, in that the subject property has extreme slope areas with unstable fill and a very small pad area on which to build. Section 3: That the variance is necessary for the preservation and enjoyment of a substantial property right, which right is enjoyed by other property owners under like conditions in the same zoning district in that variance for setbacks and parking have been granted for commercial lots having small pads and steep hillsides which dominate the majority of the lot. Furthermore, the extra compact parking space is a more desirable alternative than reducing the total number of parking spaces to be provided. Section 4: That the granting of the variance and Conditional Use Permit will not be materially detrimental to the public welfare or injurious to property and improvements in the area; in that the proposed building height has been reduced three feet so as to eliminate potential view impacts. Section 5: That the granting of the variance and Conditional Use Permit will not be contrary to the objectives of the General Plan in that the proposed use complies with the General Plan and zoning land use designations and that the project will not disturb the adjacent canyon. Section 6: That the subject site is adequate in size and shape to accommodate the intended use, subject to approval of the requested variances and the conditions of approval contained in Exhibit "A", attached hereto. Section 7: That the site is serviced by Hawthorne Boulevard and Crest Road, whose traffic capacity is adequate to serve the site without suffering significant impacts to their level of service. Section 8: That the proposed grading meets the intent of the City's grading criteria contained in the Development Code and is not excessive in terms of the proposed development of the site. Section 9: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes does hereby approve the Final Negative Declaration for Environmental Assessment No. 482, Conditional Use Permit No. 103, Variance No. 132 and Grading Application No. 859 subject to the conditions contained in Exhibit "A", attached hereto and made a part hereof, which are necessary to preserve the public health, safety and general welfare in the area. No. 86-15 EXHIBIT "A" Final Negative Declaration for Environmental Assessment No. 482, Conditional Use Permit No. 103, Variance No. 132 and Grading Application No. 859 are approved subject to the following conditions. 1) All of the recommendations made by the City Engineer and City Geologist during their ongoing review of the project shall be incorporated into the approved plan. 2) Appropriate State and/or Federal agencies shall concur in the determination made by the Initial Study that no significant adverse effects on the Palos Verdes Blue Butterfly will occur if this project is constructed as proposed. 3) The recommendations of the Director of Public Works concerning traffic safety shall be incorporated into the approved plans for this project. 4) The project plans shall be designed to improve the enframement of nearby vistas, reduce the risk of fire in Agua Armaga Canyon, and minimize the impact of off-site glare. Complete architectural, landscaping, lighting and sign plans must be submitted to the Director of Environmental Services for review and approval prior to issuance of permits. 5) A qualified archaeologist shall make frequent periodic ingrading inspections to further evaluate cultural resources on the site. If archaeological resources are found, all work in the immediate area/shall stop and the resources shall be removed or preserved. All "finds" shall be reported to the Director of Environmental Services immediately. 6) The developer shall record a map which delineates the non-structural fill as a restricted use area (as shown on the approved site plan). A copy of the recorded map shall be provided to the City prior to issuance of any permits (except for demolition permits). 7) A copy of recorded CC&R's prohibiting medical and dental uses, and also prohibiting structural use of the unstable fill area shall be provided to the City Planning Commission for review and approval prior to issuance of any permits (except for demolition permits). The CC&R's shall also make reference to the potential future requirement of trail easements and shall require the property owner to provide an irrevocable offer of dedication for such trails to the city. 8) The existing vacant building on the site shall be demolished and all debris removed within 60 days of the date of this approval. 9) Detailed landscape and irrigation plans shall be submitted for review and approval by the Director of Environmental Services prior to issuance of any permits (except demolition). Said plans shall incorporate drought tolerant plant materials. Irrigation systems shall be on automatic timers and shall be adjusted for seasonal water needs. 10) Final construction plans for the proposed building shall be in substantial conformance with the plan approved by the Planning Commission. Building colors and materials shall conform to those provided on the materials board reviewed with this project. 11) A minimum of 37 parking spaces shall be provided with a maximum of eight compact stalls. 12) The building setbacks shall not be less than: Front (Hawthorne) 16' Rear 24±' Streetside 16' Side 28±' 13) The maximum building height shall not be more than 21 feet measured from the highest existing elevation covered by the structure. 14) A sign permit shall be obtained for all signs from the Environmental Services Department. 15) This approval shall expire one year from the date of the Planning Commission action if application for building permits for construction has not been made. Construction must begin within one year of building permit application. The Planning Commission may extend these time limits if so requested prior to expiration. 16) The developer of the project shall post a cash deposit, a bond or combination thereof in an amount to be determined by the Director of Public Works to cover the costs of the following public improvements: a. Red curbing along Crest Road between the project driveway and Hawthorne Boulevard. b. Overlay of Hawthorne Boulevard from Crest Road to Ocean Crest. c. Closure of existing driveway on Hawthorne Boulevard and installation of new curb and gutter. -2- Exhib i t "A" Resolution P.C. No. 86-15 16) Continued d. Install a new 6 inch thick concrete sidewalk on Crest Road from Hawthorne Boulevard to end of property. e. Repair any damaged sidewalk along Hawthorne Boulevard. f. Landscape and irrigate parkways along Hawthorne.Boule- vard and Crest Road. g. Landscape and irrigate Hawthorne medians per direction of Director of Public Works. h. Striping, marking and signing of a Class II bike path on Hawthorne Boulevard. i. Install new wheelchair ramps on the northwest and southwest corners of Hawthorne Boulevard and Crest Road. 17) The 3.5 foot, free standing wall surrounding the parking area shall be engineered so as to prevent vehicles in the parking lot from rolling/driving into the adjacent canyon. Said wall shall encircle the parking area from Hawthorne Boulevard frontage to Crest Road frontage. 18) The trash enclosure walls shall be 6 feet high and shall have solid, self-closing gates. 19) Any and all building materials, debris and/or excavated soil which may have been inadvertently or purposely placed in the adjacent canyon resulting from construction of this project shall be removed with slopes and vegetation to be restored prior to final approval of the building permit. 20) If the nearby Eucalyptus tree lies within the subject property, all necessary steps shall be taken to ensure that said tree is not damaged or removed. 21) All utilities to the site shall be underground, including Cable Television, telephone, electrical, gas and water. All appropriate permits shall be obtained for their installation. Cable Television shall connect to the nearest trunk line at developer's expense. -3- Exhibit "A" Resolution P.C. No. 86-15
