PC RES 1986-012 RESOLUTION P.C. NO. 86 - 12
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES DENYING VARIANCE NO. 135
WHEREAS, Mr. Gary Paul has requested a Variance to allow an
existing deck, spa and patio cover built without permits in the required
rear setback to remain at 5408 Eau Claire, Rancho Palos Verdes, and;
WHEREAS, after notice pursuant to the City's Development Code,
a public hearing was held on April 22, 1986 at which time all interested
parties were given an opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there are no exceptional or extraordinary
circumstances or conditions relating to size, shape, location, or
topography applicable to the subject property.
Section 2: That a variance is not necessary to preserve or
allow the enjoyment of a substantial property right of the applicant
which is possessed by other property owners under similar conditions
in the same zoning district since surrounding properties are subject to
the same setback restrictions as the subject property.
Section 3: That a variance would be contrary to the public,
health, safety, and general welfare since the existing structure does not
comply with the minimum setback from the top of a slope that is required
by the Development Code.
Section 4: For the foregoing reasons, the Planning Commission
of the City of Rancho Palos Verdes hereby denies Variance No. 135.
APPROVED and ADOPTED this 22nd day of April, 1986.
