PC RES 1986-011 • RESOLUTION P. C. NO. 86 - 11 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES, APPROVING A REVISION TO CONDITIONAL USE PERMIT NO. 58 TO ALLOW CERTAIN ACCESSORY STRUCTURES ON LOTS 1 - 52, TRACT 39673 WHEREAS, Tumanjan and Tumanjan Investments, Inc. has requested a revision to Conditional Use Permit No. 58, Tract 39673 to allow for accessory structures on lots 1 - 52, in a Residential Planned Development (RPD) located southwest of the intersection of Beachview Drive and Coast site Drive, which is zoned Residential Single Family (RS - 4); and WHEREAS, after notice issued pursuant to the provisions of the City's Development Code, public hearings were held on January 14 , February 25 and March 11, 1986, at which times all interested parties were given an opportunity to be heard and to present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: The sites are adequate for placement of certain accessory type structures, described in Exhibit "A" attached hereto and made a part hereof. Section 2: The aforementioned accessory structures would be in conformance with the Coastal Specific Plan and the General Plan. Section 3: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby grants a revision to Conditional Use Permit No. 58, for the use described herein, subject to the conditions contained in Exhibit "A" attached hereto, which are necessary to protect the public health, safety, and general welfare in the area. NO. 86 - 11 Conditional Use Permit No. 58 is revised to allow certain accessory structures subject to the following conditions: 1. The following accessory structures shall be permitted on lots 1 - 52, inclusive, of Tract 39673: a. Spas and spa equipment ; b. Maximum 50% partial shade patio covers; c. Any other structure which does not exceed 30 inches in height above grade; d. Fences - maximum five foot in height , stepping down to any abutting perimeter walls. 2. All such structures shall be constructed of wood, stained to match or be compatible with wood trim on the units, or decorative wrought iron. 3. All patio covers shall be attached to the primary structure. Furthermore, said covers shall be no wider than the primary structure to which it is attached. 4. The maximum height of any patio cover shall not exceed 12 feet . 5. Rear setbacks shall be 50/0 of the minimum dimensions measured perpendicular to the rear property line, except that any structure of 30 inches in height or less may be closer to any property line. 6. Spa equipment shall have a minimum three (3) foot setback from any side or rear property line (not permitted in the front yard). Such equipment shall be shielded against noise. If such shielding exceeds a 30 inch height , the equipment shall respect the same setbacks as are required for spa fencing (5' minimum) on lots 1 - 9 and 39 - 52. 7. Spas on lots 1 - 9 and 39 - 52, inclusive, shall be individually fenced. Said fencing shall have a minimum five (5) foot setback from the rear property lines abutting Beachview Drive and Seacove Drive. 8. All accessory structures shall require a Site Plan Review by the Environmental Services Department prior to issuance of necessary building permits. 9. Applicant shall submit a Coastal Permit Application to the City within 30 days of the date of this resolution.
