A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING CONDITIONAL
USE PERMIT NO. 100 AND GRADING APPLICATION NO. 830
FOR A 49 UNIT RESIDENTIAL CONDOMINIUM PROJECT
WHEREAS, Rancho Palos Verdes Investors and Bredero/Hawthorne, a
partnership, have requested a Conditional Use Permit to allow a 49 unit
residential condominium project on a 6. 1 acre site; and
WHEREAS, the subject property has a General Plan designation
residential, 6 - 12 dwelling units per acre and is to be zoned RM-8 (Resi-
dential Multiple - Family , 8 units/acre) upon adoption of Ordinance No. 185;
and
WHEREAS, after notice issued pursuant to the provisions of the City's
Development Code, a public hearing was held on September 24, 1985, November 12, 1985,
January 28, 1986, and February 25, 1986 at which time. all interested parties
were given an opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That the proposed condominium project is permitted in
multiple family zones, subject to the issuance of a Conditional Use Permit .
Section 2: That the 6.1 acre site, located on Hawthorne Boulevard
is adequate in size and configuration to allow for 49 multiple family dwelling
units and common area, private outdoor living areas, landscaping, and other
features required by the Development Code or by conditions imposed by this permit .
Section 3: That the proposed project is not contrary to the General Plan
since said conformance has been insured by site design and landscaping requirements,
which are included as conditions of approval to this permit and Tentative Tract
Map No. 44239.
Section 4: That the project will utilize private streets that are
designed to carry both the type and the quantity of traffic generated.
Section 5: That given the project 's location, site design, and conditions
imposed through this permit , the granting of this Conditional Use Permit will not
significantly adversely affect the peace, health, safety, or general welfare of
the area, nor will it be materially detrimental to property values, jeopardize,
endanger or otherwise constitute a menace to the public health, safety, and
welfare of persons in the surrounding area.
Sect ion 6: That the Planning Commission does hereby declare that addendum
to Final Environmental Impact Report No. 22 has been completed in compliance with
State and local environmental guidelines and that the Commission has reviewed and
considered its contents in reaching its decision. The Planning Commission further
finds that the approval of this Conditional Use Permit will not result in a
significant adverse environmental impact , since mitigation measures are required.

Section 7: For the foregoing reasons the Planning Commission of
the City of Rancho Palos Verdes hereby grants approval of Conditional Use Permit
No. 100 and Grading Application No. 830 subject to the attached conditions marked
Exhibit "A" and subject to City Council approval of Tentative Tract Map No. 44239.

CONDITIONAL USE PERMIT NO. 100 AND GRADING APPLICATION NO. 830 ARE APPROVED
SUBJECT TO THE FOLLOWING CONDITIONS:
1. No more than forty nine (49) condominium dwelling units shall be permitted.
2. Final site plans and building plans (meeting all Development Code standards
for condominiums) showing all proposed imiprovements shall be submitted to
the Director of Environmental Services for approval prior to approval of the
final map. The site plan shall clearly show all pad and finished grade
elevations as established on the concept plan approved by the Planning Commission.
3. Landscaping and irrigation plans (which include street trees) shall be submitted
for approval to the Director of Environmental Services. Said plans should strive
to create a "natural" appearance. Said plans shall include, but not be limited
to, proposed plant materials, walls/fences, and lighting. Bonds and agreements
for landscape improvements shall be submitted prior to approval of the final
tract map. The final landscape plan shall be designed in a way so that views
from adjacent properties will not be significantly adversely affected.
4. Approval of this Conditional Use Permit is subject to the approval of Tentative
Tract Map No. 44239 by the City Council without substantial changes or
modifications hereto.
5. Prior to the approval of the final map, copies of covenants, conditions and
restrictions (CC&Rs) shall be submitted to the Director of Environmental
Services and City Attorney for approval. Said CC&Rs shall reflect standards
provided in Chapter 17.14 (Homeowners Association) of the Development Code and
include those items identified below:
a. Maintenance of the commonly owned areas, including all private streets
shall be ensured through the establishment of a homeowners' association
(or equal) . Furthermore, maintenance fees for said area cannot be
reduced without written approval of the City.
b. Identify all factors that involve structure appearance and use restrictions.
c. Membership in the homeowners' association shall be inseparable from
ownership in the individual condominium.
d. All structures must conform to City approved building plans and maximum
grade elevations as shown on the site plan.
e. That the developer shall provide for the maintenance of the private streets
until such a time as the homeowners' association assessments can be
responsible for it.
f. That no guest parking shall be used for permanent or semi-permanent storage
or parking of any vehicles (including recreational vehicles) belonging to
residents of the development.
g. The homeowners' association shall be responsible for enforcing all parking
regulations contained in the CC&Rs.

h. Parking shall not be permitted in any other portion of the private streets
other than designated guest parking.
i. All landscaping (including parkway trees) shall be maintained so that no
tree or group of trees significantly obstructs views from adjacent
properties.
j. In BOLD, specific language, the homeowners Association shall be
informed of its responsibility to maintain any off-site improvements
and/or easements.
6. The private streets shall be designated and signed for "No Parking/Fire Lane,"
except in the approved parking locations. Said sign(s) shall be reviewed by
the Director of Environmental Services.
7. Prior to issuance of a building or grading permit, and prior to approval of a
final map, a bond, or other acceptable security shall be posted to ensure the
completion of all common area and off-site improvements including: landscaping,
recreational facilities, street signs, and other site features as per approved
plans.
8. All units shall be required to have and maintain in proper working order an
electronic garage door opener for each garage door.
9. Building colors shall be earth-toned. Samples shall be submitted to the Director
of Environmental Services for approval prior to final map approval.
10. The perimeter wall along Hawthorne Blvd. shall have a maximum solid height of 3.5
feet, with decorative wrought iron above to a total height of 5 feet. The solid
portion shall be compatible with building colors.
11. All units shall be insulated to ensure that interior noise levels do not exceed
forty-five (45) decibles (db) with all doors and windows closed.
12. All units shall be provided thermostatically controlled heating and air-
conditioning, utilizing state-of-the-art energy conserving systems and equipment.
13. All graded slopes shall not have smooth parallel contours, but rather, shall be
graded so as to create a natural appearance. Final grading plans shall be
reviewed and approved by the Director of Environmental Services prior to
approval of the final map.
14. Floor plans shall indicate that 400 cubic feet of storage space is to be provided
in each private garage.
15. All streets shall be built to City standards with a 28 foot width.
