A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES APPROVING VARIANCE NO. 133
WHEREAS, Stephen and Kerry Richards have requested a Variance
to allow an existing covered patio to encroach 1 foot 8 inches into the
required side yard setback at 6110 Armaga Spring Drive.
WHEREAS, after notice pursuant to the City's Development Code,
a public hearing was held on February 11, 1986, at which time all interested
parties were given an opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional or extraordinary
circumstances or conditions applicable to the size, shape, topography or
location of the subject property, since the orientation of the lot and
structure result in prolonged exposure to sunlight in the rear yard area.
Section 2: That a variance is necessary to preserve or allow
the enjoyment of a substantial property right of the applicant which is
possessed by other property owners under similar conditions in the same
zoning district , since encroachment into the setback is necessary to
construct a patio which would provide adequate shade to the rear yard
and primary living areas of the residence.
Section 3: That the granting of the Variance will not be
materially detrimental to the public welfare or injurious to surrounding
property and improvements since emergency access through the side yard is
maintained.
Section 4: That the granting of the Variance will not be contrary
to the objectives of the General Plan.
Section 5: For the foregoing reasons, the Planning Commission
of the City of Rancho Palos Verdes hereby app = , -s Variance No. 133.
