RESOLUTION P.C. NO. 86-4
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES RECOMMENDING APPROVAL OF A REVISION TO TENTATIVE
TRACT MAP 37885 AND THE SUPPLEMENTAL EIR TO FINAL EIR NO. 16,
AND APPROVING A REVISION TO CONDITIONAL USE PERMIT NO. 79
WHEREAS, Palos Verdes Properties has requested a revision to Tentative
Tract Map. No. 37885 and Conditional Use Permit No. 79 which would alter the approved
lot configuration of said Tract Map but would not alter the number of lots within
said Tract; and
WHEREAS, a supplemental EIR to Final EIR No. 16 has been prepared and
reviewed in accordance with State guidelines, and
WHEREAS, after notice issued pursuant to the provisions of the City's
Development Code, public hearings were held on Tuesday, August 28, 1984 and January
28, 1986, at which time all interested parties were given an opportunity to be heard
and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES
DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: That the proposed revisions to the approved Tentative Tract
Map No. 37885 and Conditional Use Permit No. 79 are consistent with the Supplemental
EIR to Final EIR No. 16, the City's Development Code and the General Plan.
Section 2: That the 163 ± acre site of the subject tract is adequate
in size and configuration to accommodate the 47 single family lots as proposed in
the revision under an RPD concept.
Section 3: That the proposed revision would significantly reduce remedial
grading necessary for the construction of Mainsail Drive.
Section 4: That the proposed lot reconfiguration reduces the overall
density of the originally approved configuration.
Section 5: That lots 45 and 46 shall require approvals from the U.S. Fish
and Wildlife Service prior to development.
Section 6: That geologic review of the entire Tract will confirm geologic
stability of all lot locations prior to final approval of the map.
Section 7: That given the proposed revision and configuration, site design
and conditions contained herein, the granting of this revision to Tentative Tract Map
37885 and Conditional Use Permit No. 79 will not significantly adversely affect the
peace, health, safety, or general welfare of the area, nor will it be materially
detrimental to property values, jeopardize, endanger or otherwise constitute a menace
to the public health, safety and welfare of persons in the surrounding area.

Section 8: F�the foregoing reasons, the Planning Commission of the
City of Rancho Palos Verdes hereby recommends City Council approval of the pro-
posed revision to Tentative Tract Map 37885 and approval of the Supplemental EIR
to Final EIR No. 16, and approves the revisions to Conditional Use Permit No. 79
for the use described herein, subject to the conditions contained in Exhibit "A",
attached hereto, which are necessary to protect the public health, safety, and
general welfare in the area.

EXHIBIT "A"
RESOLUTION P.C. NO. 86- 4
1. The Planning Commission hereby recommends that the City Council adopt the
following conditions in approving the revision to Tentative Tract Map 37885:
a. Development of lots 45 and 46 shall require all necessary approvals from
the U.S. Fish and Wildlife Service.
b. Prior to beginning grading activity in the area, a qualified team of
archaeologists and/or paleontologists shall excavate and remove all
recoverable remains of the whale skelton found on-site, and report all
finds to the Director of Environmental Services.
c. A qualified paleontologist shall be present during all rough grading
operations. If paleontological resources are found, the paleontologist
shall stop all work in the affected area and all resources shall be
excavated or preserved. All "finds" shall be reported to the Director of
Environmental Services immediately.
d. A qualified archaeologist shall make frequent periodic ingrading inspections
to further evaluate cultural resources on the site. If archaeological
resources are found, all work in the immediate area shall stop and the
resources shall be removed or preserved. All "finds" shall be reported to the
the Director of Environmental Services immediately.
e. Additional subsurface investigation shall be undertaken to accurately de-
lineate the extent of unsuitable materials on lots 45 and 46.
f. Condition #39.a of Council Resolution No. 82-66 is amended by adding the
following:
In addition, the geologic stability of the 47 residential lots shall be
confirmed to the satisfaction of the City Geologist prior to final map
approval.
g. All references to the "Engineering Geology Section" shall hereinafter be
taken to mean "The City Geologist".
h. Condition #29 of Council Resolution No. 82-66 is amended as follows:
Down cast, sodium vapor (or equivalent) streetlights shall be installed
by the developer at street intersections and a maximum of two locations along
Forrestal Drive within the Tract. Said streetlight standards shall be
shown on the required landscape/irrigation plans and shall be subject to
review and approval by the Public Works Director and Southern California
Edison Company. All maintenance costs of said streetlights shall be borne
by the Homeowners' Assocation. This responsibility shall be duly recorded
in the C.C. & R's.

i. Condition No. 3 of Council Resolution No. 82-66 is amended as follows:
"Drainage plans and necessary support documents to comply with the
following requirements shall be approved by the City Engineer and
the Director of Public Works prior to the filing of a final map."
2. All conditions of approval of Council Resolution No. 82-66 and Resolution
P.C. No. 82-20 shall continue to apply to this newly revised Tentative
Tract Na.p 37885 and Conditional Use Permit No. 79.
3. Resolution P.C. No. 82-20 is amended by adding the following conditions:
23. The developer shall provide a haul route map for construction/grading
purposes. Said route shall avoid all endangered flora as identified
in the. Supplemental EIR to Final EIR No. 16, and be approved by the
Director of Environmental Services. In addition, said flora shall be
fenced-off per approvals of the U.S. Fish and Wildlife Service and
State Department of Fish and Game.
24. The owners shall, in the C.C. & R's, specifically spell out in bold,
underlined type that the project includes the Homeowners' Assocation's
obligation to maintain all of the common area included in the tract,
and equestrian trails and other trail networks within the tract;
assuming all liability and costs therefor, and shall duly record same
on all grant deeds.
