A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES APPROVING -VARIANCE NO. 127.
WHEREAS, Mr. Kosaku Kusuga has requested a Variance to allow the
height of his residence to exceed the 30 foot height allowed by the Development
Code by 8 feet as a result of the addition of an attached deck at 29901 Avenida
Magnifica, Rancho Palos Verdes, and;
WHEREAS, after notice pursuant to the City's Development Code, a
public hearing was held on December 10, 1985 at which time all interested
parties were given an opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS.
Section 1: That there are unusual circumstances relating to the
size, shape, topography or location of the subject property which prevent the
reasonable development of the property in conformance with the Development
Code since the property has a trapezoidal shape with extreme slopes at the rear
of the residence which limit the useable rear yard area.
Section 2: That such variance is necessary for the preservation and
enjoyment of a substantial property right of the applicant that is possessed by
other property owners under like conditions in the same zoning district since
the deck is necessary to allow the property owner reasonable recreational use of
his rear yard.
Section 3: That the granting of such Variance would not -he -materially
detrimental to surrounding properties since the structure has been in place for
several years with no apparent adverse effect on other properties.
Section 4: That the granting of such a variance would not be contrary
to the objectives oT the General Plan.
Section 5: For the foregoing reasons, the Planning Commission of
the City of Rancho Palos Verdes hereby approves Variance No. 127 and directs
the applicant to apply for building permits.
