PC RES 1985-025 RESOLUTION P.C. NO. 85-25
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES APPROVING VARIANCE NO. 128
WHEREAS, Mr. H.R. Rizzi has requested a Variance to allow
construction of a carport which would encroach four(4) feet into the required
twenty (20) foot front yard setback and to reduce the required amount of open
space within the front yard setback to 30% from 50% at 30503 Santa Luna Drive,
Rancho Palos Verdes, and;
WHEREAS, after notice pursuant to the City's Development Code, a
public hearing was held on September 10, 1985, at which time all interested
parties were given an opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there are unusual circumstances relating to the
size, shape, topography or location of the subject property which do not apply
generally to other property in the same zoning district since the subject lot
is irregularly shaped and located at the end of a cul-de-sac and the existing
house extends fully across the lot.
Section 2: That such variance is necessary to preserve or allow
the applicant to enjoy a substantial property right which is enjoyed by other
property owners under similar conditions in the same zoning district since it
would allow the applicant to construct a covered car storage area.
Section 3: That approval of said variance will not be materially
detrimental to the public welfare or injurious to property and improvements in
the area in which the property is located since the project design minimizes
the profile of the structure.
Section 4: That the granting of such a variance will not be
contrary to the objectives of the general plan.
Section 5: For the foregoing reasons, the Planning Commission
of the City of Rancho Palos Verdes hereby grants Variance No. 128 subject to
the conditions listed, in the attached exhibit "A" which are necessary to protect
the public health, safety and welfare.

EXHIBIT "A"
The conditions of approval for Variance No. 128 are as follows:
1. The minimum setback from the front property line shall
be sixteen (16) feet.
2. A minimum of 30% of the front yard setback area shall
remain open space.
3. Access to the carport from both the north and south sides
is required.
4. The approved carport must comply with all applicable City
Development regulations except as noted above.
5. Approval of this Variance shall expire within one year unless
application is made for all required building permits.
