A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES DENYING VARIANCE NO. 123
WHEREAS, La Solana Coporation has requested a Variance to
allow an existing air conditioner to remain, thereby encroaching into
the required side yard setback to remain at 30102 Avenida Celestial,
Rancho Palos Verdes and;
WHEREAS, after notice pursuant to the City's Development
Code, a public hearing was held on July 23, 1985, at which time all
interested parties were given an opportunity to be heard and present
evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there are no exceptional or extraordinary
circumstances or conditions applicable to the subject property.
Section 2: That a variance is not necessary to preserve or
allow the enjoyment of a substantial property right of the applicant
which is possessed by other property owners under similar conditions
in the same zoning district.
Section 3: For the foregoing reasons, the Planning
Commission of the City of Rancho Palos Verdes hereby denies approval
of Variance No. 123.
