A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES APPROVING VARIANCE NO. 122 AND
GRADING APPLICATION NO. 812 TO ALLOW CONSTRUCTION OF A
NEW SINGLE FAMILY RESIDENCE WITH A TEN FOOT FRONT
SETBACK FOR A DIRECT ACCESS GARAGE, AND A 16'-4" HEIGHT
WITH A 31'-4" DOWNSLOPE HEIGHT.
WHEREAS, the applicant, Mr. Frederick Kearns, has requested approval
of Variance No. 122 and Grading No. 812 to build a new single family residence
with a 10 foot front setback on a direct access garage and also having an ac-
tual height of 16'-4" with a downslope height of 31'-4" at property located at
6317 Via Colinita; and
WHEREAS, after noticing pursuant to the City's. Development Code, pub-
lic hearings were held on June 25, 1985, and July 9, 1985, at which time all
interested parties were given the opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional or extraordinary circumstances
or conditions applicable to the property involved, or to the intended use of the
property, which do not apply generally to other property in the same zoning
district; in that the topography of the subject lot, particularly at the front
property line, creates difficult circumstances relating to vehicular access and
building height.
Section 2: That such variance is necessary for the preservation and
enjoyment of a substantial property right of the applicant, which right is
possessed by other property owners under like conditions in the same zoning
district; in that the neighborhood pattern of this area features steep sloping
lots and reduced garage setbacks with heights typically exceeding those allowed
in this zoning district. This variance would allow the applicant to enjoy the same.
Section 3: That the granting of the variance will not be materially
detrimental to the public welfare or injurious to property and improvements in the
area in which the property is located; in that the proposed garage setback would
allow for off-street parking not now available on Via Colinita and the
additional building height will not adversely affect surrounding views.
Section 4: That the granting of such a variance will not be contrary
to the objectives of the General Plan.
Section 5: That the grading proposed in Grading No. 812 meets the
intent of the City's Development Code.
Section 6: For the foregoing reasons, the Planning Commission of the
City of Rancho Palos Verdes hereby approves Variance No. 122 and Grading No. 812
subject to the conditions contained in Exhibit "A", attached hereto.

EXHIBIT "A"
RESOLUTION P.C. NO. 85-18
VARIANCE NO. 122 and GRADING NO. 812 are approved subject to the following
conditions:
1. The new garage shall be equipped with roll-up type, articulated
doors and automatic door openers prior to finaling of the building permit.
2. Grading beyond that shown on the approved plans shall be for
purpose of landscaping and drainage only, and shall not exceed a total of
20 cubic yards of cut and/or fill.
3. All plans shall be reviewed and approved by the City's
Building Official, Engineer, and Geologist prior to issuance of any permits.
4. The proposed house shall be connected to the existing public
sewer lines located in the Via Colinita right-of-way. Private, on-site
sewerage systems shall not be permitted.
5. All site and roof run-off (drainage) shall be controlled in a
manner approved by the City Engineer.
6. The applicant shall provide detailed erosion control plans for
approval by the Director of Environmental Services prior to issuance of
grading permits.
7. The proposed single family residence shall not exceed a height
of 16'-4" as measured from the average elevation of the front property line, or
31'-4" as measured from the garage ridgeline to the top of the lowest retaining
wall foundation on the downslope side of the house.
8. All proposed grade elevations shall be verified by the
Building Official prior to pouring .aay, foundations.
