PC RES 1985-009 RESOLUTION P.C. NO. 85- 9 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES, APPROVING VARIANCE NO. 117 AND COASTAL PERMIT NO. 12 TO ALLOW CONSTRUCTION OF A GARAGE WITHIN THE 20 FOOT FRONT SETBACK AT 4144 PALOS VERDES DRIVE SOUTH WHEREAS, Captain and Mrs. Allen Dempsey have applied for Variance No. 117 and Coastal Permit No. 12 to allow construction of a garage within the 20 foot front setback and; WHEREAS, a public hearing was held on Tuesday, May 14, 1985, at which time all interested parties were given an opportunity to testify and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That there are exceptional or extraordinary circumstance or conditions applicable to the property involved or to the intended use of the property, which do not apply generally to other property in the same zoning district, in that the character of development of this lot and the surrounding lots differs substantially, from what is required in the RS-5 zoning district in terms of setbacks and lot size. Section 2: That such Variance is necessary for the preser- vation and enjoyment of a substantial property right of the applicant which is possessed by other property owners under like conditions in the same zoning district since the subject lot is currently the only lot in the immediate neihgborhood which is not developed with a 5 foot building setback and which does not have an enclosed garage. Section 3: That the granting of the Variance would not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located in that the proposed develop- ment would be more consistent with the existing development in the neighborhood. Section 4: That the granting of such a Variance would not be contrary to the objectives of the General Plan nor the policies and requirements of the Coastal Specific Plan. Section 5: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby approves Variance No. 117 and Coastal Permit No. 12 subject to the conditions in Exhibit A. NO. 85-9 EXHIBIT 'A' Conditions of approval: (1) The subject property shall be surveyed by a licensed surveyor, prior to the issuance of a building permit, in order to precisely determine the location of the front property line. (2) A minimum driveway length of 15 feet measured from the garage door to the face of the curb is required. (3) An articulated door with an automatic garage door opener shall be installed.
