A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES, APPROVING VARIANCE NO. 115
AND COASTAL PERMIT #11, TO ALLOW A DECK TO ENCROACH
INTO THE 20 FOOT FRONT SETBACK AT 4161 MARITIME
WHEREAS, Mr. Michael O'Brien has applied for Variance #115 and
Coastal Permit #11 to allow an illegally constructed deck to encroach into
the 20 foot front setback and private roadway easement; and
WHEREAS, public hearings were held on Tuesday, February 26th and
April 23rd, 1985, at which time all interested parties were given an opportunity
to testify and present evidence,
NOW, THEREFORE, THE PLANNING COMIJISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINES, AND RESOLVES AS FOLLOWS:
Section 1. That there are exceptional or extraordinary circumstances
or conditions applicable to the property involved, or to the intended use of
the property, which do not apply generally to other property in the same
zoning district; in that the subject property is nonconforming in lot area and
dimensions for the RS -5 zone and the structure and lot existed prior to
adoption of the Coastal Specific Plan and Setback Line.
-Section 2. That such Variance is necessary for the preservation and
enjoyment of a substantial property right of the applicant, which right is
possessed by other property owners under like conditions in the same zoning
district; in that all of the structures on neighboring properties have
substandard setbacks, many including decks and balconies.
- Section 3. That the granting of the Variance will not be materially
detrimental to the public welfare or injurious to property and improvements
in the area in which the property is located; in that the subject deck, as
modified, would blend in with existing neighborhood conditions, and not be
obtrusive in nature.
Section 4. That the granting of such a Variance will not be contrary
to the objectves of the General Plan or the policies and requirements of the
Coastal Specific Plan; in that the subject deck, as modified, more closely
meet the intent of both the General Plan and Coastal Specific Plan.
'Section 5. For the foregoing reasons, the Planning Commission of the
City of Rancho Palos Verdes, hereby approves Variance #115 and Coastal Permit #11.
