PC RES 1985-006RESOLUTION P. C. NO. 85-6 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES APPROVING CONDITIONAL USE PERMIT #96, VARIANCE #116 AND THE FINAL NEGATIVE DECLARATION FOR ENVIRONMENTAL ASSESSMENT 4461 WHEREAS, the Roman Catholic Archbishop of Los Angeles has made application to construct a church social/meeting hall at St. John Fisher Parish, located at 5448 Crest Road; and WHEREAS, after public hearings were held on February 26, March 12, and April 9, 1985 at which time all interested parties were given an oppor- tunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That the site is adequate in size and shape to accom- modate the intended expansion. Section 2: That the site for the proposed expansion relates to streets and roadways properly designed to carry the type and quantity of traffic generated by the use; Section 3: That by approving the expansion at the specific loca- tion, there would be no significant adverse impacts on the adjacent proper- ties or permitted uses thereof; Section 4: That there are exceptional or extraordinary circumstan- ces or conditions applicable to the property involved, or to the intended use of the property, which do not apply generally to other property in the same zoning district; in that the intended use of the property would not utilize simultaneous demand for proposed parking facilities, and Section 5: That such variance is necessary for the preservation and enjoyment of a substantial property right of the applicant, which right is possessed by other property owners under like conditions in the same zoning district; in that other religious facilities in the Institutional zone have the same right for full service facilities and to conduct a full range of activities so long as they are not simultaneous, and Section 6: That the granting of the variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located; in that there would be no significant adverse impacts associated with the proposed struc- ture and its location, and Section 7: That the granting of such a variance will not be contrary to the objectives of the General Plan. #701CP-.5 Section 8: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby approves the Final Negative Declara- tion for Environmental Assessment No. 461, Conditional Use Permit No. 96, Variance No. 116 subject to conditions found in Exhibit A, attached hereto. NO. 85-6 #701cp.5.1 EXHIBIT "A" Conditional Use Permit 496, Variance #116, Final Negative Declaration for Environmental Assessment IP461 are approved subject to the following conditions: 1. This approval shall expire one year from the date of adoption if application for building permits have not been made. Extension may be granted by the Planning Commission for up to one additional year. Extension must be granted prior to expiration. 2. A watering truck shall be employed during construction phases to control dust. 3. The applicants shall submit a grading application to be approved by the Director of Environmental Services prior to application for building permits. 4. Site landscape/irrigation plans shall be approved by the Director of Environmental Services prior to application for building permits and installed prior to occupancy of the building. 5. The Church facilities shall be operated in such a manner so as to avoid a use which would exceed the 359 parking spaces on site. An agreement to this effect shall be recorded by the applicant prior to issuance of building permits. Should demand for parking spaces exceed the approved capacity, the Church shall utilize attendant parking (using tandem parking) to increase parking capacity. Should parking situations arise which exceed on site capacity which threaten the public health, safety and welfare, the City may bring this C.U.P./Variance application back for re -review to determine appropriate cor- rective measures. 6. The applicant shall post a cash deposit or bond or combination thereof to cover the costs for the following improvements: In the Crenshaw Boulevard right-of-way: a. Removal and replacement of pavement suffering heavy "alligator" failures. b. Placement of a 1.5 inch asphaltic concrete overlay to the centerline of said streetalong entire frontage. C. one-half of a raised landscaped median, including land- scaping and irrigation. d. Removal of Asphaltic Concrete paving behind median curbing and backfilling with soil. #701CP-.5.2 In the Crest Road right-of-way: a. Installation of an eight (8) inch P.C.C. curb and gutter from the existing curb return to the storm drain inlet. b. Removal of existing Asphaltic Concrete paving behind said curb and soil filling with soil. C. Asphaltic Concrete patching from roadway to new gutter. 7. The applicant shall submit plans subject to the City's Trails Standards Plan, for approval by the Director of Environmental Services, to improve designated equestrian trails within the public right-of-way along its property frontage along Crest Road and Crenshaw Boulevard. In addition, the applicant shall post a cash deposit or bond for the improvement of said trails in an amount to be determined by the Director of Environmental Services. Should the Trails Improvements not be implemented by the City within seven (7) years of the posting of said bond or deposit, it shall be released to the applicant. These improve- ments will necessitate the relocation of certain existing improvements. 8. Final building plans, including elevations, materials and lighting shall be approved prior to application for building permits. 9. Existing, exterior lighting (on standards) shall be shielded in such a manner so that illumination shall be restricted only to the Church property itself. Plans shall be reviewed by the Environmental Services staff prior to the issuance of any necessary permits and occupancy of the new building. EXHIBIT "A" PLANNING COMMISSION -2- RESOLUTION P.C.
