A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES APPROVING VARIANCE NO. 112
WHEREAS, the applicant, Dr. Lewis, has applied for Variance No. 112
which requests that the wall and gate which exceed forty-two inches (42")
in height in the front setback be allowed to remain at 6264 Ocean Terrace
Drive; and
WHEREAS, after notice pursuant to the City's Development Code, a
public hearing was held on November 27 and December 11, 1984 at which
time all interested parties were given the opportunity to be heard and
present evidence.
NOW, THERFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS
Section 1: Granting this variance is necessary because of site con-
straints including cul-de-sac location and sloping terrain which create exceptional
or extraordinary circumstances or conditions that exist relative to this
property which do not apply generally to other properties in the same zoning
district which necessitate a wall and gate which exceed forty-two inches
(42") to encroach into the front setback.
Section 2: Granting this Variance is necessary for the "preservation
and enjoyment of a substantial property right of the applicant which right is
possessed by others under like conditions" as the existing wall and gate which
exceed forty-two inches (42") in height is necessary to provide security for
improvements on the subject lot.
Section 3: Granting this Variance would not result in adverse effects
to the public welfare and therefore this finding can be justified.
Section 4: That granting this variance is not contrary to the objectives
of the General Plan
Section 5• For the foregoing reasons, the Planning Commission of the
City of Rancho Palos Verdes hereby approves Variance No. 112.
APPROVED and ADOPTED this 15th day of January 1985.
