A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES DENYING VARIANCE NO. 113
WHEREAS, the applicant, Steven Tondre, has applied for Variance
No. 113 which requests that the existing storage shed encrocaching 7 feet
into the 10 foot streetside setback be allowed to remain at 1809 Peninsula
Verde Drive; and
WHEREAS, after notice pursuant to the City's Development Code, a
public hearing was held on January 15, 1985 at which time all interested
parties were given the opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: 'Granting this Variance is unnecessary because there
are no exceptional or extraordinary circumstances or conditions that exist
relative to this property which do not apply generally to other properties in
the same zoning district which would necessitate a storage shed being located
in the 10 foot streetside setback.
Section 2: 'Granting this Variance is unnecessary for the "preservation
and enjoyment of a substantial property right of the applicant which right is
possessed by others under like conditions: as the existing storage shed in the
streetside setback is deemed unnecessary in that other property owners of
corner lots of similar size do not necessarily have storage sheds located in
the streetside setback.
Section 3: Granting this Variance would not result in adverse effects
to the public welfare and therefore this finding may be justified.
Section 4:. This Variance would not be contrary to the City's General
Plan.
Section 5: *For the foregoing reasons, the Planning Commission of the
City of Rancho Palos Verdes hereby denies Variance No. 113, and requires that
the storage shed be removed from the streetside setback.
