A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES APPROVING VARIANCE NO. 110
WHEREAS, Mr. & Mrs. Michael J. Nopper requested a Variance for the
construction of a single family residence at 4109 Seahorse Lane which would
encroach 13 feet into the minimum required front setback of 20 feet, resulting
in a 7 foot front setback at the 2nd story balcony; and
WHEREAS, after notice issued pursuant to the provisions of the Rancho
Palos Verdes Development Code, a public hearings was held on September 25, 1984,
at which time all interested parties were given an opportunity to be heard and
present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional or extraordinary circumstances
or conditions applicable to the property involved, or the intended use of the
property, which do not apply generally to other property in the same zoning
district; in that the subject lot and dimensions are substandard in size in
relation to Development Code standards for a newly created RS -5 Lot.
Section 2: That such Variance is necessary for the preservation and
enjoyment of a substantial property right of the applicant, which right is
possessed by other property owners under like conditions in the same zoning
district; in that the property owners in this Tract with substandard lots all
enjoy the right of having front setbacks of less than 20 feet. The subject
Variance would allow the Noppers to enjoy the same.
Section 3: That the granting of such a Variance will not be materially
detrimental to the public welfare or injurious to property and improvements in
the area in which the property is located; in that only the front setback require-
ments would not be met and the project will otherwise be in conformance with the
Development Code. The subject property would not be injurious to other property
owners in the Tract.
Section 4: That the granting of such a Variance will not be contrary
to the objectives of the General Plan or the policies and requirements of the
Coastal Specific Plan.
Section 5: For the foregoing reasons, the Planning Commission of the
City of Rancho Palos Verdes hereby approves Variance No. 110 subject to the
conditions contained in Exhibit A attached hereto.
APPROVED and ADOPTED this 25th day of September, 1984.
