A RESOLUTION OF THE PLANNING C014MISSION OF THE CITY OF
RANCHO PALOS VERDES "PROVING VARIANCE NO. 108
WHEREAS, Richard Beattie has requested a Variance to allow a
deck addition to his existing house which would cause said structure to
exceed the overall 30 foot height limit, pursuant to Section 17.02.040.D
of the Development Code, by 9 feet 6 inches; and
WHEREAS, after notice issued pursuant to the provisions of the
Rancho Palos Verdes Development Code, public hearings were held on August 28,
1984 and September 11, 1984, at which time all interested parties were given
an opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional or extraordinary
circumstances or conditions applicable to the property involved, or
the intended use of the property, which do not apply generally to other
property in the same zoning district; in that the existing structure
presently exceeds the maximum 30 foot height by five (5) feet and the
additional height from the proposed decking is a "downward" versus an
"upward" height.
Section 2: That such Variance is necessary for the preservation
and enjoyment of a substantial property right of the applicant, which right is
possessed by other property owners under like conditions in the same zoning
district; in that the proposed location of the decking is the only acceptable
location in terms of slope (28%) conditions.
Section 3: That the granting of such a Variance will not be
materially detrimental to the public welfare or injurious to property and
improvements in the area in which the property is located in that the
proposed decking would not be highly visible to the majority of
surrounding properties.
Section 4: That the granting of such a variance will not be
contrary to the objectives of the General Plan; in that the proposed decking
would provide increased useable outdoor living area for a private residence on
a buildable slope.
Section 5: For the foregoing reasons, the Planning Commission
of the City of Rancho Palos Verdes hereby approves Variance No. 108.
APPROVED and ADOPTED this 25th day of September, 1984.

EXHIBIT "A"
1. The applicant shall submit a revised site plan reflecting the change
in building footprint orientation prior to submittal for building plan
check with the Building and Safety Division.
2. The applicant shall install an automatic garage door opener on the
subject house to be built at 4109 Seahorse Lane.
3. The approval of Variance No. 110 shall expire one (1) year from the
date of adoption, unless an extension is granted by the Planning
Commission prior to expiration.
