A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES APPROVING VARIANCE NO. 98; ENCLOSURE OF AN EXISTING DECK IN THE STREET
SIDE SETBACK, AND EXPANSION OF A NON-CONFORMING STRUCTURE PURSUANT TO PARKING
REQUIREMENTS.
WHEREAS, the Admiral Risty Restaurant has requested a variance to allow the
enclosure of an existing covered deck which is partially located in the required
thirty (30) foot front setback and which additionally, due to an increase in
restaurant seating capacity, will thereby increase the parking space requirements
where a shortage of spaces currently exists pursuant to the Development Code at
31250 Palos Verdes Drive West, Rancho Palos Verdes; and
WHEREAS, after notice pursuant to the City's Development Code, a public
hearing was held on April 10, 1984 at which time all interested parties were given
opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES
DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: Granting the 'variance is necessary because there are exceptional
circumstances that exist relative to this property, namely that the restaurant
building existed prior to the adoption of the setback and non-conforming structure
ordinances found in the Development Code. The restaurant was constructed within
said setback which creates an exceptional circumstance that is applicable to
this property which does not generally apply to other property in the same zoning
district.
Section 2: That this variance is necessary for the preservation and enjoyment
of a substantial property right of the applicant, which right is possessed by other
property owners under like conditions in the same zoning district since other property
owners in the same commercial district with proper setbacks and adequate parking
facilities would be allowed the same improvements.
Section 3: That granting this variance will not be materially detrimental to
the public welfare or injurious to property and improvements in the area in which
the property is located since it will not interfere with future and/or adjacent
development patterns.
Section 4: That granting this variance is not contrary to the objectives of the
General Plan.
Section 5: For the foregoing reasons, the Planning Commission of the City of
Rancho Palos Verdes hereby approves Variance No. 98.
