RESOLUTION P.C. NO. 83-13
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES RECOMMENDING
ADOPTION OF CODE AMENDMENT NO. 15 PROHIBITING
SECOND UNITS
WHEREAS, the City has initiated Code Amendment No. 15; for Second
Unit regulation; and
WHEREAS, the Planning Commission has held public hearings on this
matter on February 22, 1983, April 12, 1983, April 26, 1983 and September 13,
1983, at which time all interested parties were given an opportunity to be
heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY RECOMMEND TO THE CITY COUNCIL AS FOLLOWS:
Section 1: That the General Plan of the City of Rancho Palos Verdes
was designed by a process involving over 200 citizens representing all areas of
the City.
This plan and its compatible zoning mandated by the State of California was the
result of consideration of the following criteria, constraints, and factors:
1. Reasonable growth.
2. Sewer availability, carrying capacity of soils in areas where
sewers are not available.
3. Certain recognized areas of instability and landslide.
4. The possibility that additional areas of instability may be found.
5. A major arterial highway across an existing landslide which makes
it difficult to traverse and a tremendous financial burden to
maintain.
6. An existing high percentage ratio (24%) of multiple to single
family dwelling units not including rented single family homes.
7. A Coastal Zone seven and one half miles in length with two major
regional recreational facilities in the coastal zone serving
tourists and the Los Angeles County area.
8. Valuable view corridors.
9. Steep slopes requiring extreme measures to control grading,
drainage and erosion.
10. The natural beauty of the area.
11. The desires of the residents of the region as expressed at
numerous public hearings.
12. The generation of residential noise and parking and on street
congestion.
The General Plan, it's Environmental Impact Report and the existing zoning defined
in the Development Code are in concert with all of the above criteria, constraints,
and factors. The Development Code describes densities that are at a maximum in
every area of the City given the above criteria, constraints, and factors. Therefore,
the imposition of second units upon the existing single-family and multi-family
residential neighborhoods would have significant adverse impacts upon the health,
safety, and welfare of the residents of the City.
Therefore, the Code revisions are necessary to prohibit second units. While this
action may have the potential to limit a single type of housing opportunity within
the region the consequences of allowing this type of housing would be detrimental
to the region as stated above.
Section 2: That a Negative Declaration was issued for the project.
Section 3: For the foregoing reasons, the Planning Commission of the
City of Rancho Palos Verdes hereby recommends approval of Code Amendment No. 15,
pursuant to Exhibit "A" attached.

ADD- 16.04.1035 Second Unit. "Second Unit" means either a
detached or attached dwelling unit which provides complete,
independent living facilities for one or more persons.
It shall include permanentprovisions for living, sleeping,
eating, cooking, and sanitation on the same parcel or
parcels as the primary unit is situated.
223 17.02.020 17.02.020 Uses and development permitted. Only the
following uses and developments may be conducted or con-
structed:
A. Single-family residential and associated accessory
buildings for the residential use and occupancy of not more
than one family and not more than one dwelling unit per lot.
ADD- Nothing in this section shall be construed to permit second
units as provided for in Section 65852.1 et. seq. of the
California Government Code;
227 17.04.020 17.04.020 Uses and development permitted. Only the following
uses and developments may be conducted or constructed:
A. Single-family and multiple-family residential structures
(not including mobile homes) and associated accessory
buildings for the residential use and occupancy of not more
than one family per dwelling unit and related recreational
and community facilities for the_.use Jof:the residents of the
development. All new multiple-family developments permitted
only with a conditional use permit pursuant to Chapter 17.56.
ADD- Nothing in this section shall be construed to permit second
units as provided for in Section 65852.1 et. seq. of the
California Government Code;
