PC RES 1983-010RESOLUTION P.C. NO. 83-10 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DENYING VARIANCE NO. 92. WHEREAS, Mr. John Muckel has requested a Variance for the construction of a wall within the street -side setback, and; WHEREAS, after notice issued pursuant to the provisions of the Rancho Palos Verdes Development Code, a public hearing was held on June 28, 1983 and July 12,,_1983 T -at which time a1I interested parties were ā€˛given 4an opportunity -to be -heard and -present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: Section 1: That there are no exceptional or extraordinary circumstances or conditions applicable to the property involved which do not apply generally to other property in the same zoning district because other properties located on corners are subject to the same lot conditions. Section 2: That such variance is not necessary for the preservation and enjoyment of a substantial property right of the applicant, which right is possessed by other property owners under like conditions in the same zoning district, because neighboring properties subjected to the same lot conditions have been developed without exceeding the Municipal Code's street - side setback requirements. Section 3: That the granting of the variance would adversely affect the public welfare and surrounding properties due to the reduction of the landscaped area adjacent to public right-of-way. Section 4: That the granting of such a variance will be contrary to the objectives of the General Plan since the proposed project is contrary to the General Plan's policies regarding the enhancement of the open character of the City. Section 5: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes does hereby deny Variance No. 92.
