A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES APPROVING
VARIANCE NO. 88
WHEREAS,, Mr. Robert J. Morin has requested a variance for the construction
of additional residential square footage, and;
WHEREAS, after notice issued pursuant to the provisions of the Rancho
Palos Verdes Development Code, public hearings were held on January 25 and
February 8, 1983 at which times all interested parties were given an opportunity
to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional or extraordinary circumstances
or conditions applicable to the property involved which do not apply generally
to other property in the same zoning district since the optimum roof design is
that proposed, any other design would be architecturally inappropriate and the
number of mature trees and shrubs would mitigate any visual impact.
Section 2: That this variance is necessary for the preservation and
enjoyment of a substantial property right of the applicant, which right is
possessed by other property owners under like conditions in the same zoning
district since other property owners in the same district could be allowed the
same improvements under such similar circumstances.
Section 3: That granting this variance will not be materially detrimental
to the public welfare or injurious to property and improvements in the area in
which the property is located since it has been determined that no significant
view obstruction will occur.
Section 4: That granting this variance is not contrary to the objectives
of the General Plan.
Section 5: For the foregoing reasons, the Planning Commission of the
City of Rancho Palos Verdes hereby approves Variance No. 88.

"EXHIBIT "A"
AN AMENDMENT TO CONDITIONAL USE PERMIT NO. 37 IS HEREBY APPROVED
SUBJECT TO THE FOLLOWING CONDITIONS:
1. This Conditional Use Permit amendment shall expire on November 10,
1984. �-
2. The landscaping originally approved by the Director of Planning must be
replaced within ninety (90) days.
3. A watering program shall be scheduled until the plants are established.
4. Within thirty (30) days of this date, the applicant shall submit a
written statement certifying that all of the above conditions are under-
stood and agreed upon.
