A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING VARIANCE
NO. 84
WHEREAS, Nori Marumoto has requested a variance for the construction
of a garage encroaching into the rear yard setback on the property located at
6947 Alta Vista Drive; and
WHEREAS, after notice issued pursuant to the provisions of the Rancho
Palos Verdes Development Code, public hearings were held on August 10 and
September 14, 1982, at which time all interested parties were given an opportunity
to be heard and present evidence.
NOW, THEREFORE THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional or extraordinary circumstances
or conditions applicable to the property involved, or to the intended use of
the property, which do not apply generally to other property in the same
zoning district because the retaining wall was approved by Los Angeles County
Building and Safety Department; the retaining wall currently exists and would
not be safe to remove and restore; proposed structure is more aesthetically
pleasing (view enhancement point of view) with a double pitched roof ( 16 ft.
maximum above finished floor).
Section 2: That such variance is necessary for the preservation and
enjoyment of a substantial property right of the applicant, which right is not
possessed by other property owners under like conditions in the same zoning
district because there are two easements on the property which reduce net
buildable area and alternative locations for the garage.
Section 3: That the granting of the variance will not be materially
detrimental to the public welfare or injurious to property and improvements
in the area in which the property is located because the proposed structure
will not obstruct a public and/or private View.
Section 4: That the granting of such a variance will not be contrary
to the objectives of the General Plan.
Section 5: For the foregoing reasons, the Planning Commission of the
City of Rancho Palos Verdes hereby approves Variance No. 84 subject to the
attached conditions (Exhibit "A").
APPROVED and ADOPTED this 28th day of September 1982.

EXHIBIT "A"
Variance No. 84 is approved subject to the following conditions:
1. That the rear retaining wall remain where currently located.
2. That the pitch of the roof at the rear of the building be made equal
to the pitch at the front of the roof, as indicated on the applicant's
sketch presented to the Commission on September 14, 1982.
3. That the roof treatment (materials) be the same as the rest of the
structure on the lot.
4. That an acceptable plan be submitted prior to approval.
