A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES APPROVING VARIANCE NO. 86
WHEREAS, Variance No. 86 has been filed which requests approval to divide
an existing 27,831 square foot parcel into two substandard size lots: 13,695
and 14,136 square feet (Tentative Parcel Map No. 3649); and
WHEREAS, the vacant lot is located approximately 500 feet east of the
Crest Road and Palos Verdes Drive East intersection, which is in an RS -2 zoning
district; and
WHEREAS, a Negative Declaration was granted in compliance with City and
State guidelines and the Commission-has--reu_ewe.d -and- considered =the contents �of the
Initial Study (Environmental Assessment No.. 399) in reaching its decision; and
WHEREAS, proper notice was made pursuant to the provisions of the City's
Development Code and a hearing was held on September 14, 1982, at which time all
interested parties were given an opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES
DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional or extraordinary circumstances
applicable to this property, or to the intended use of the property, which do
not apply generally to other properties in the same zoning district because the
parcel is oversize in relation to surrounding properties and the parcel has full
width street frontage at both ends.
Section 2: That the variance is necessary for the preservation and en-
joyment of a substantial property right of the applicant, which is possessed by
other property owners under like conditions in the same zoning district, since
the proposed size and configuration of each lot is consistent with surrounding
lots in the same zoning district.
Section 3: That the granting of the variance would not be materially
detrimental to the public welfare or injurious to properties and improvements
in the surrounding area,since each lot would provide adequate area for develop-
ment of a single family dwelling and the creation of an additional lot would not
adversely affect surrounding views.
Section 4: That the granting of the variance is not contrary to the
intent of the General Plan since it is for only two lots, only one of which
would have access to Palos Verdes Drive East in a section which has been widened
and where numerous other lots have access.
Section 5: For the foregoing reasons, the Planning Commission of the
City of Rancho Palos Verdes hereby approves Variance No. 86, subject to the
resolution and conditions of Tentative Parcel Map No. 3649.
APPROVED and ADOPTED this 14th day of September, 1982.
