A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES GRANTING
VARIANCE NO. 65 FOR A SIDE PROPERTY LINE
WALL THAT RANGES IN HEIGHT FROM 8 FEET TO
11 FEET, A SIDE YARD DECK THAT EXCEEDS 30
INCHES, AND A REAR YARD DECK THAT EXCEEDS
30 INCHES.
WHEREAS, Mr. Shultz has requested a variance to allow a recently con-
structed side property line wall that exceeds six (6) feet, a side yard deck that
exceeds thirty (30) inches, and a rear yard deck that exceeds thirty (30) inches
in height at 4170 Maritime Road, Rancho Palos Verdes; and
WHEREAS, after notice pursuant to the City's Development Code, a public
hearing was held on May 26, 1981, at which time all interested parties were given
an opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That an administrative error occurred in the issuance of
building permits for the side property line wall and the side yard deck.
Section 2: That there are exceptional or extraordinary circumstances
applicable to the property involved, or to the intended use of the property which
do not apply generally to other property in the same zoning district, since the
lot is only 4000 square feet in an RS -1 zone.
Section 3: That such a variance is necessary for the preservation and
enjoyment of a substantial property right of the applicant, which right is
possessed by other property owners under like conditions in the same zoning dis-
trict, the railing and windscreen are necessary for safe usage of the rear deck.
Section 4: That the granting of the variance will not be materially
detrimental to the public welfare or injurious to the property and improvements
in the area in which the property is located since the deck is compatible with
others in the area and the transparentness of the windscreen allows it to exist
without obstructing any views.
Section 5: That the intended use is not contrary to the General Plan.
Section 6: For the foregoing reasons, the Planning Commission of the
City of Rancho Palos Verdes hereby grants approval of Variance No. 65.
