NO. 81-41 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES GRANTING CONDITIONAL USE PERMIT NO. 72 AND VARIANCE NO. 64 (PARKING) FOR THE CONSTRUC- TION OF A MULTI-PURPOSE USE BUILDING, AND DENYING VARIANCE NO. 57 (SETBACK) WHEREAS, the Salvation Army has requested a Conditional Use Permit for the construction of a multi-purpose gymnasium building with variances for a setback encroachment of thirteen (13) feet into a sideyard and a reduction of the required parking spaces at 30840 Hawthorne Boulevard; and WHEREAS, after notice pursuant to the-Ranchb-Palos Verdes Developm6nt Code, a public hearing was held on April 20, 1981, at which time all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That the use is permitted in an Institutional zone subject to the issuance of a Conditional Use Permit. Section 2: That the site is adequate in size for the proposed use. Section 3: That the subject use, with conditions imposed by this per- mit, will cause no significant adverse effects to adjacent properties or the permitted uses thereof. Further, the Planning Commission does hereby declare that a Negative Declaration was granted in compliance with the City and State guidelines and that the Commission has reviewed and considered the contents of the Initial Study (Environmental Assessment No. 394) in reaching its decision. Section 4: That the subject use is not contrary to the General Plan, which designates the site as appropriate for the approved use. Section 5: That given the project's location, design, adjacent uses, lot configuration and topography, the site is adequate to accommodate the pro- posed use, subject to approval of a -variance which allows for a forty-three (43) space reduction in parking. Section 6: In denying the setback variance, the Planning Commission finds as follows: A. That there are not exceptional or extraordinary circumstances ap- plicable to the property involved, or to the intended use of the property, which do not apply generally to other property in the same zoning district. B. That such a variance is not necessary for the preservation and en- joyment of a substantial property right of the applicant, which right is possessed by other property owners under like conditions in the same zoning district. C. That the granting of the variance will not be materially detrimental to the public welfare or injurious to property and improvements in the area in which the property is located, since this will not interfere with surrounding property owners or individual improvements made by those property owners. D. That the intended use is not contrary to the General Plan. Section 7: In approving the parking variance, the Planning Commission finds as follows: A. That there are exceptional or extraordinary circumstances or condi- tions applicable to the subject property, or to the intended use of the property, which do not apply generally to other property in the same zoning district, be- cause of the use of mass transportation for members, the need for additional parking is remote. B. That the variance is necessary for the preservation and enjoyment of a substantial property right of the applicant, which is possessed by other property owners under like conditions in the same zoning district, since the impact of scheduling special activities will not appreciably increase the need for additional parking. C. That the granting of the variance would not be significantly materially detrimental to the public welfare or injurious to property and improvements in the surrounding area, since adequate availability of parking on the site will not cause the surrounding property owners undue impact. D. That the granting of the variance is not contrary to the General Plan. Section 8: For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby grants approval of Conditional Use Permit No. 72 and Variance No. 64, subject to the conditions found in Exhibit "A", and denies Variance No. 57. No. 81-41 EXHIBIT "A" CONDITIONAL USE PERMIT NO. 72 AND VARIANCE NO. 64 ARE APPROVED SUBJECT TO THE FOLLOWING CONDITIONS: 1. This permit expires one (1) year from the date of approval unless building permits have been applied for. 2. All grading, landscaping, exterior lighting, and building plans shall be approved by the Director of Planning prior to any permits or con- struction. 3. Any significant change -(determined by the Director of Planning) to the plan or use shall require a revision to the Conditional Use Permit. 4. The evening hours of use shall not extend beyond 10:00 p.m. 5. The developer shall provide trash enclosures for all trash bins in accordance with City -approved plans. 6. Eleven (11) of the parking spaces which are eliminated by the new con- struction shall be relocated throughout the existing parking areas. A plan for said relocation shall be submitted to the Director of Planning. 7. The applicant shall file a statement, in writing, with the City within thirty (30) days of this approval that he has read land understands the conditions herein imposed on this project. 8. A master plan for the entire facility shall be submitted for conceptual approval by the Director of Planning. 9. A statement signed by the Salvation Army, a California corporation, must be received by the Environmental Services Department verifying the fact that cadets are permitted to maintain and possess a maximum of twenty- five (25) automobiles while residing or attending classes at this site, and that should this regulation change in any way the City shall be notified.
