NO. 81-38 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES GRANTING CONDITIONAL USE PERMIT NO. 63 AND VARIANCE NO. 49 FOR THE CONSTRUCTION OF AN ADDITION TO AN EXISTING RELIGIOUS FACILITY IN AN INSTITUTIONAL ZONE WHEREAS, Saint Paul's Lutheran Church has requested a conditional use permit and variance for the construction of an addition to an existing building at 31290 Palos Verdes Drive West in an Institutional zone; and WHEREAS, after notice issued pursuant to the provisions of the City's Development Code, public hearings were held on January 13 and April 20, 1981, at which times all interested parties were given an opportunity to be heard and present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE,, AND RESOLVE AS FOLLOWS: Section 1: That the proposed use is permitted in the zone subject to the issuance of a conditional use permit. Section 2: That the site is served by Palos Verdes Drive West, which is designed to carry the type and quantity of traffic generated by the proposed use. Section 3 ' : That the subject use, with safeguards and conditions im- posed by the permit, will cause no significant adverse effects to adjacent properties or the permitted uses thereof. Further, the Planning Commission does hereby declare that a Negative Declaration was granted in compliance with City and State guidelines and that the Commission has reviewed and considered the contents of the Initial Study (Environmental Assessment No. 388) in reaching its decision. The Planning Commission further finds that the approval of this condi- tional use permit will not result in a significant adverse environmental impact. Section 4: That the subject use is in conformity with the General Plan, which designates the site appropriate for the approved use. Section 5: That given the project's location, design, adjacent uses, and lot configuration and size, the site is adequate to accommodate the proposed use, subject to approval of a variance to allow forty-two (42) on-site spaces plus full reciprocal parking with the adjacent Golden Cove Shopping Center in lieu of the Code required one hundred forty-eight (148) on-site parking spaces. Section 6: In approving the variance, the Planning Commission finds as follows: A. That there are exceptional or extraordinary circumstances or conditions applicable to the subject property, or to the intended use of the property, which do not apply generally to other property in the same zoning district, since the intended activities of the church and the shopping center have been -found not to occur simultaneously, but at different times and, there- fore, would not require the number called for in the Code, and the joint use parking will allow for auxiliary parking when overflow situations arise. B. That the variance is necessary for the preservation and enjoyment of a substantial property right of the applicant, which is possessed by other property owners under like conditions in the same zoning district, since the Code allows for the use of joint parking agreements. C. That given the development patterns within the area, the structure's orientation and location within an Institutional district, the grant- ing of the variance will not be materially detrimental to the public welfare or injurious to property and improvements in the surrounding area. D. That the intended use is not contrary to the General Plan. Section 7 ' : For the foregoing reasons, the Planning Commission of the City of Rancho Palos Verdes hereby grants approval of Conditional Use Permit No. 63 and Variance No. 49, subject to the conditions found in Exhibit "A", which are necessary to protect and preserve the health, safety, and general welfare in the area. No. 81-38 EXHIBIT "A" CONDITIONAL USE PERMIT NO. 63 AND VARIANCE NO. 49 ARE HEREBY APPROVED SUBJECT TO THE FOLLOWING CONDITIONS: 1. All final site, building, parking lot plan, landscaping, irrigation, light- ing, and grading plans shall be approved by the Director of Planfiing prior to issuance of construction permits. 2. All signs (existing and proposed) shall be subject to the provisions of Chapter 6, Part 7, of the Development Code. 3. The proposed addition shall not exceed 2,990 square feet. 4. A periodic review and approval of parking facilities and joint parking agreements may be made by the Director of Planning to ensure adequacy. 5. A landscape plan shall be prepared and implemented, which includes appro- priate landscaping and a permanent irrigation system on all existing and/or proposed undeveloped land. 6. The applicant shall execute a joint parking agreement with Golden Cove Shopping Center which shall provide for full reciprocal parking between the two properties. The parking agreement shall be reviewed and approved by the City Attorney prior to issuing building permits. 7. A minimum of ten (10) additional temporary parking spaces shall be provided within a radius of three hundred (300) feet as measured from the church entrance in accordance with an approved parking lot plan. Construction of the parking area shall conform to the development standards (Section 9636) of the Code and must be completed prior to issuing an occupancy permit for the addition. 8. An improved walkway between Golden Cove Center and Saint Paul's Church shall be constructed in accordance with an approved plan and must be com- pleted prior to issuing an occupancy permit for the addition. 9. The applicant shall improve Palos Verdes Drive West frontage to the center- line of the road with signing, striping, curb and gutter and such other improvements as may be required by the Director of Public Works. A bond or cash deposit covering the cost of improvements may be filed with the City to satisfy this condition. 10. The trailer shall be removed from the premises prior to issuing building permits.
