RESOLUTION P.C. NO. 80-29
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES APPROVING VARIANCE
NO. 58
WHEREAS, Variance No. 58 has been filed which requests that fence
heights exceed the six (6) foot allowable height; and
WHEREAS, the residence is located at 7449 Via Lorado, which is in an
RS -4 zoning district; and
WHEREAS, the Planning Commission reviewed this matter at a public hear-
ing on December 23, 1980, at which time all interested parties were given an
opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1: That there are exceptional or extraordinary circumstances
or conditions applicable to the property or to the intended use of the property,
which do not apply generally to other properties in the same zoning district
because the slope of the lot in the area of the spa is extremely steep and a
nine -foot fence is required for safety.
Section 2: That the variance is necessary for the preservation and
enjoyment of a substantial property right of the applicant which is possessed
by other property owners under like conditions in the same zoning district. The
fence is required for safe use and enjoyment of the spa as required in Section 1
above.
Section 3: That the granting of the variance will benefit the public
welfare by allowing the spa to be enclosed safely. The wall will not obstruct
anyone's view.
Section 4: That the granting of such a variance will not be contrary
to the objectives of the General Plan. The wall will allow safe usage of a
private recreational facility.
Section 5: For the foregoing reasons, the Planning Commission of the
City of Rancho Palos Verdes hereby approves Variance No. 58 for the use de-
-scribed herein subject to the conditions contained in Exhibit "A", which are
necessary to protect the public health, safety, and general welfare in the area.
APPROVED and ADOPTED this 23rd day of December, 1980.

EXHIBIT "A"
VARIANCE NO. 58 IS APPROVED SUBJECT TO THE FOLLOWING CONDITIONS:
1. An appropriate drainage plan for the area behind where the spa
structure lies in the drainage course be submitted to the Director
of -Planning.
2. That such plan be implemented once approved.
