A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF RANCHO PALOS VERDES GRANTING
VARIANCE NO. 45
WHEREAS, Variance No. 45 has been filed, which would allow a wall within
the front yard setback to exceed the allowable height at 30865 Casilina to enclose
a pool; and
WHEREAS, the Planning Commission has reviewed this matter at a public
hearing held on November 13, 1980, at which time all interested parties were
given an opportunity to be heard and present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF RANCHO PALOS
VERDES DOES -'HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS:
Section 1. That there are exceptional or extraofdinary circumstances
or conditions applicable to the property, or to the intended use of the
property, which do not apply generally to other properties in the same zoning
district because the location of the pool and jacuzzi necessitates a wall 5'
tall in the front setback.
Section 2. That the variance is necessary for the preservation and
enjoyment of a substantial property right of the applicant which is possessed
by other property owners under like conditions in the same zoning district.
The wall will allow the pool to be used.
Section 3. That the granting of the variance will benefit the public
welfare by allowing the pool to be enclosed safely in accordance with Rancho
Palos Verdes Development Code Section 9623A. The wall will not impede traffic
safety along Casilina.
Section 4. That the granting of such a variance will not be contrary
to the objectives of the General Plan. The wall will allow safe usage of a private
recreational facility.
Section 5. For the foregoing reasons, the Planning Commission of the
City of Rancho Palos Verdes hereby approves Variance No. 45 for the use described
herein, subject to the conditions contained in Exhibit "A", which are necessary
to protect the public health, safety, and general welfare in the area.
APPROVED and ADOPTED this 13th day of November, 1980.

EXHIBIT "A"
VARIANCE NO. 45 IS HEREBY APPROVED SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the wall in the front setback on the west side of the property shall
not exceed forty-two (42) inches in height, as determined by the Planning
Commission.
2. That no part of any wall may exceed six (6) feet maximum height.
3. That within thirty (30) days the applicant shall submit a statement in
writing indicating he has read and understands all conditions,of approval.
