A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF RANCHO PALOS VERDES RECOMMENDING TO THE CITY
COUNCIL OF SAID CITY AMENDMENTS TO THE MUNICIPAL
CODE FOR THE REGULATIONS OF FENCES
The Planning Commission of the City of Rancho Palos Verdes does hereby resolve,
determine, and recommend as follows:
Section 1. On November 6, 1979, the City Council initiated a code
amendment as recommended by the Ordinance Review Subcommittee that would allow
six foot high decorative fences to within five feet of the front property line
with approval of a minor exception permit.
Section 2. That a negative Declaration was issued for the project on
December 6, 1979.
Section 3. That the Planning Commission held a duly noticed public hearing
on March 11, March 25, April 7, and May 13, 1980 at which time all interested
persons had an opportunity to present testimony.
Section 4. That the Planning Commission recommends against the adoption of
the Code Amendment as recommended by the Ordinance Review Subcommittee.
Section 5. That the Planning Commission hereby recommends to the City
Council that the Rancho Palos Verdes Development Code, Article A, chapter 6 ,
Part Two is hereby amended to read:
CHAPTER 6, PART 2 -- FENCES, WALLS AND INTERSECTION VISIBILITY STANDARDS
9620 PURPOSE
These standards provide for the construction of fences and walls as
required for privacy and protection against hazardous conditions and to
protect against dangerous visual obstructions at street intersections.
For the purpose of this part, on lots abutting a private street the
street easement line shall be interpreted as the property line.
9621 FENCES, WALLS AND HEDGES PERMITTED
A. Front and street-side setback areas.
Fences, walls and hedges up to forty-two (42) inches in height
shall be permitted within the front or street-side setback areas.
B. Rear and side setback areas.
Fences, walls and hedges up to six (6) feet in height shall be
permitted on any part of the lot behind the front or street-side
setback line.
C. Combined fences, walls and hedges.
Where a grade difference exists between properties, fences,
walls and hedges up to eight (8) feet, measured from grade on
the lower side of the fence, wall or hedge, shall be permitted
on the property line behind the front or street-side setback
line.
9622 FENCES, WALLS AND HEDGES PERMITTED WITH A MINOR EXCEPTION PERMIT
A. Front and street-side setback area.
1. Interior, flag and reversed corner lots.
Fences, walls and hedges up to six (6) feet in height no
closer that ten (10) feet to the front or street-side
property line.
2. Other corner lots.
Fences, walls and hedges up to six (6) feet in height no
closer than ten (10) feet to the front property line and
no closer than five (5) feet to the street-side property
line.
The area between the street and any such fence, wall or hedge
described above shall be landscaped, per an approved plan, in
conjunction with the minor exception permit application

B. Combined fences, walls and hedges.
Where a grade difference exists between properties, fences,
walls and hedges up to ten (10) feet, measured from &rade on
the lower side of the fence, wall or hedge, shall be permitted
on the property line behind the front or street-side setback
line.
C. Fences for recreational facilities.
Fences over six (6) feet in height (not within the required
setbaek areas) for tennis courts or similar recreational
facilities may be permitted with a minor exception permit
provided that all of the structure above the six (6) foot
height shall be constructed of wire mesh, or similar
material, capable of admitting at least ninety (90) percent
of light as measured on a reputable light meter. Windscreens
exceeding six (6) feet in height may only be permitted with
a minor exception permit when the Director finds that views
from affected property will not be significantly adversely
affected.
9623 FENCES OR WALLS REQUIRED
A. All pools shall be enclosed by a structure and/or a fence or
wall not less than five (5) feet in height measured from the
outside ground level at a point twelve (12) inches horizontal
from the base of the fence or wall. Any gate or door to the
outside shall be equipped with a self-closing device and a self-
latching device located not less than four (4) feet above the
ground. Such fences, walls and gates shall meet City specifica-
tions.
9624 FENCES OR WALLS PROHIBITED
A. Barbed wire.
The use of barbed wire in conjunction with any fence, wall or
hedge, or by itself, is prohibited unless required by any law
or regulation of the State of California or Federal Government
or any agency thereof.
9625 INTERSECTION VISIBILITY
A. Corner lots.
On corner lots in all Districts, no fence, wall, hedge, sign or
other structure, shrubbery, mounds of earth, or other visual
obstruction over forty-two (42) inches in height above the
nearest street curb elevation shall be erected, placed, planted,
or allowed to grow within the triangular space formed by the
intersection curb lines and a line joining points on the curb
sixty (60) feet (measured along the curb lines) from the point
of intersection of the curb line extensions. In Districts
where the required front or street-side setbacks permit con-
struction of a building within this triangular space, fences,
walls, other structures or shrubbery behind the required front
or street-side setback line is exempted. Trees which are trimmed
to the trunk to a height at least six (6) feet above the nearest
street curb elevation are also exempted. Conditions existing
as of effective date of this Code which do not conform to
this Part need only be brought into compliance upon the finding,
by resolution of the City Council, that a hazard to public
safety exists.
